Bought BTC from a guy with Paypal and got scammed by him.

Recently, I bought 0.45 BTC from a guy for hundreads of dollars, I choose Paypal as a payment, then after submiting the payment to him. he didn't replied to my message, and I didn't get my BTC!

I'm waiting for him 1 hour now and there is no replies!

What do I have to do now? PLEASE HELP!!

It will depend if it's his real paypal account or a fake, I mean if he are a "pro scammer" it will be more complicated, I don't know all the process regarding the charge back but I'm sure you have good chance to take back your money, if it's a member from here open a shit list but wait a little more maybe he have some problem even if it's very look like scam

If that member is from BHW you can start a shitlist against him .

He is not from BHW, I found him on eBay, then I ask him to open a listing on eBay for safety purpose, he told me that he's out of free listing, and he can't make a listing, so he can make it again after a month from now!

I taked the risk and deal with him with Paypal ONLY. then i'm waiting him right now.

I couldn't found a way to refund my payment, there is ONLY report it as Unauthorized payment.

Nope, I've send the payment to his as payment with Goods and services.

If you have paid via Paypal and your option is " Paid for Good & Services " you can easily dispute that amount.

That's good, all you need to do now is start a dispute and claim item not received. Once you escalate it to paypal don't type anything inside, just leave it untill paypals dedline when they decide.
Speaking from experience: had 100s of transactions with no disputes, 1 user scams me by disputing after receiving digital goods. He starts a dispute where I provided all skype logs, email logs etc, user didn't even answer the dispute and won it.

Yes, I found it on report an issue. they asked me to type a message to the seller, I types "I didn't receive the item yet!"
they refer the message to the seller, and they told me you have to wait the seller to respond.

Is this fine? Do you think they hold the money now from being withdrawed?

"unauthorized payment" is when you are hacked, if you use this option you will lose because you authorized the payment and they know it, take the "not received item" option

Don't worry about that. If you won the case, you'll get your money back either way. If his balance covers the disputed amount, PayPal will simply take it from there, if not, PayPal will still take it from there, only his balance will go to negative.

Btw OP, are you for real? You don't get a response in an hour and you open a dispute? I'm not saying that this is not a scam, but at least wait a day FFS, PayPal disputes can be opened for 180 days after the transaction took place and you have the same chance winning or losing it throughout the whole period.

To be honest with you, I can't wait MORE to get the bitcoins released to my wallet, the matter fact is when I deal with him, he always respond in a time too short, now after I send him the payment, he told me I have to eat, then no replies after!

I just wake up this morning and I didn't get any message from him!

From the beginning, this guy seems suspicious to me, and with a few minutes later, I got an email from eBay that an ebay User recently found to have been accessed by an unauthorized third party! I think this guy has plenty of stealth account out there, he's is from Peru, but The paypal account seems to be Australian based (Since Paypal asked me to convert the amount I sen to him to AUD curency)

Because of that, and to make sure that his funds are not withdrawed yet, I opened a dispute that the item not RECEIVED!

I got this message from Paypal when I'm trying to escalate it!

"Please allow some time for your order to arrive. If you don't receive your order by Saturday, 15 April 2017, you may escalate to PayPal."

Then you have probably shot yourself in the foot, as it wasn't unauthorized at all.
If they investigate and see the payment came from your IP address then you are telling them lies and they will crap over you from a great height.

What happened was you never received the goods, which is the reason you reported this to them. If the seller cannot prove delivery, you should get your money refunded, but never try to bullshit them.

you have already filed a dispute now its paypal's responsibility to hold the money until he delivers bitcoins
however don't mention anything about bitcoins in your dispute
