Hello Folks, I had like 10 accounts banned on xVideos for copyright along the years, in the last one I was really careful and had a tons of videos on it, I have got 1 strike and then thea 2nd one and now I am not uploading anymore because with the 3rd strike i will be banned again !

My question is, how can I tell if a porn video is copyrighted and I can not watermark it ?

I am fed up to grow my accounts and get banned when they start to have millions of views !

thanks

Hey man, here's a good rule in regards copyright:

Did you make it?

if NO - you aren't legally allowed to upload it and/or use it. The only way you can use it is to either 1. wait until it falls into the public domain (30-60 years depending on where you live) or 2. obtain the rights from the copyright holder. (note that I did not include fair use here since I'm not sure of its applicability in what you're doing).

if YES - happy watermarking & uploading.

You do not need a copyright symbol (©) to protect your intellectual property, so if you want to reuse certain videos you cant simply feel free to copy works just because they don’t have a copyright notice. I guess you could message the holders and perhaps make a rev-share agreement for licensing their videos, although I don't think you'll have much luck.

Taken from xvideos section on piracy:

Please note that Xvideos specifically reserves the right to pursue damages, costs and legal fees available by law in the event a copyright owner or a user submits a copyright infringement notice or counter-notice without a good faith belief regarding the infringing or non-infringing nature of particular content, or to the extent an individual submitting a notice or counter-notice makes any material misrepresentations to Xvideos.

Note that I'm not a lawyer, so don't take my word as legal advice. If I were you, I would research 'fair use', 'DCMA', 'video licensing' and find content regarding this specific industry and/or your national laws. Please note that international treaties may make this process very difficult for you.
