Just checked Matt's interview with Theo:

Matt said (min 40) that were successful at shutting down Festinger via cease and desist, but he acknowledge the business practice it's not illegal. This was before the court hearings.
Matt's still doesn't have a case, by using the name of the plugin you are not violating a trademark, and Festinger doesn't null the plugins unless it has to, which in that case it should be documented.
However, I believe there's still no precedent on how GPL software could potentially violate trademarks. Festinger ought to make one and it appears he won. Still I believe, Festinger has to be more careful from now on and don't use trademarked assets on his site.

Yeah Matt said they did a cease and desist and shut down Festinger operations, which they did obviously, but that interview was before the court hearings.
Our boy said the future is expected to be bright so he might actually have won.
