Domain Question

Say someone registers the domain Lovingbit.co.in

Then, say someone owns the domain co.in and creates the Lovingbit subdomain, so both domains read lovingbit.co.in

Whos site would it point to??

I doubt that you can obtain a domain such as co.in, which has already been obtained by part of the India's gov itself.

.in is also an extension.

Surely Whoever owns co.in is the same person that controls all domains registered under that extension?

co.in as a domain and co.in as a domain extension must be the same thing no? Just like technically speaking there could be a url that was just co.uk, if the owners of that tld put up a webserver on the root domain?
