Copyright Notice because of thumbnail

So I got copyright notice because of thumbnail. Should I appeal it? Because I got thumbnail from searching creative-commons pictures at flickr.com but as I checked it right now it isn't creative commons (I guess maybe he changed the copyrights? Or I made a mistake and didn't search for CC pictures but I'm pretty sure I did because that's what I do always).

Should I contact youtube and tell the story and offer to change the thumbnail? That one copyright strike really worries me because I'm basically making a living off that one channel (it produces about 85% of my income). One copyright strike might seem like a small thing but it really worries me, you never know when you get another two.

Also a long time ago I made a rule if I get copyright strike I do nothing with the channel for the next 6 months until the notice is gone (by nothing I mean I don't upload videos) because that's just safer. Although this will give me a chance to invest time on other projects I haven't worked a lot I still worry by income from this channel might drop since it's currently my main source of income.

In the Copyright Counter-Notification I get this message:

• A counter-notification is a legal notification to YouTube that the claimant has made a mistake or misidentified your content. To prevent your content from being reinstated to YouTube, the claimant must sue you. If you are not prepared to face the claimant in court, you should not proceed with a counter-notification. If there is any part of this process that is unclear to you, please consult with a lawyer.

Does this mean that If I submit Copyright Counter-Notification, my video will get back live and get my copyright notice deleted? Then I just could change the thumbnail and I would be trouble-free?

Sounds like you made an honest mistake. I would change the thumbnail out to one that is public domain or creative commons license. Then report that the problem has been resolved to youtube.

Or safer, delete the video and then upload it again with a thumbnail you can legally use.

Dispute it, but only if you know how to do it correctly. I've gotten 2 copyright strikes in the past year so far cause of the content I had in the video & I easily got them removed, & I do use a lot of copyright materials.

I can't change the thumbnail, I can't do anything to the video because of the copyright notice. It shows me "Removed (copyright strike). Submit Counter-Notification". All I can do is to Submit Counter-Notification or delete the video and I'm pretty sure deleting the video won't get rid of my copyright notice

I have never disputed anything so I don't know the right way to do it, therefore I'm scared I could mess up things ever more.

When I got a copyright notice, I created a new channel, added the same videos, and directed people to the NEW channel to subscribe. I now have 2 notices on my first channel, but my second channel is already making more $ then the original. I'd suggest start working on your new channel, just to be safe. Between the 2 channels, I RULE the first couple pages of SERP's
