Replica site shut down by nike!! what now??

Threads pretty old.. Hopefully he did things for the better.
 
I got a crazy idea. Take $200 and go talk to a lawyer. Show him/her your C & D letter and get some professional legal advice.

I wonder why people keep posting so badly offtopic on Blackhat tools.
At least up to now I did not consider a nike replica as "black hat tool", maybe you can throw it at your competition but that's all they can be used for.
 
An easy way for Nike to find you is to purchase something from your site and then to track the money trail.

For all the time and effort you're putting into this you could probably be very profitable doing something legit.

here is how i would do it. now i havent looked into this so i dont know if its feasible. I know it can be done wiht a panama corp, hosting, bankaccount and merchant account.
1. set up a chinese corporation
2. sell the domain to the chinese corporation
3. chinese coporation get merchant account
4. chinese corporation opens bank account with debit card
4. chinese corporation get hosting
5. start selling

or find any of your competition or a chinese company seeling fakes and sell them your business. show them 3-6 months of your sales and traffic and viola, SOLD!

Seriously, it is not worth it to keep going because the domain is still registered to you. They have the information how you bought the domain. So your fake info is meaningless until they take the next step then you are fucked.
 
I've gotten tons of cease and desist letters on my old sites and never had any problems. I was spending XXXX/day on adwords so all the companies new my site, but it was all set up properly so they couldn't find me. I've since quit the biz, it's not like it used to be.....
 
How much money can you make in prison to help your family member get surgery? Go legit dude. If you don't know how to work a system for selling counterfeit stuff online and you have to ask people on a public forum, you're best to just shut things down and forget it and enjoy the money while it lasted.

Re-read his post wise guy. Hes not asking how to run his bizness. In fact hes already ahead of the feds with his "plan B". In the criminal world you plan first then carry out on your own. He originally asked if hes was safe with a small option. Anybody with a brain knows "blowin up the spot" is a big risk to them and their bizness.

well i had to have something covered somewhat right because on the letter they dont even have my correct info. they have the wrong info with the name of someone who is not even real. so if they were on top of their sh@#$! it seems like they would have the correct info. I wish i could find a connect with real jordans so i can just sell those, but of course i cant find one. so i have talked to a guy in my area and he has been doing this for 10 years and he said he has had cease and desist letters from nike 3 or 4 times already and each time he just shuts the site down and nike never responds again. he also said that he doesnt even use off shore hosting and thay all he does is use vc cards with fake name and address to buy the domain name and for everything like i thought about ( although i think im sticking with offshore hosting) and he says they can never find out who he is because they think he is a different person each time. the reason i find that easy to believe is because as i stated earlier they did not even get my info correct on the letter they sent me. honestly if they had my correct info, that may have made me want to stop a little bit more. but because they didnt its almost like a small victory. but i dont know, if someone knows of how to get real nikes put me down!! then i wont have to worry about this. i can sell real nikes for a $150. they will move at any price

heha I like ur thoughts. A small victory? I woulda said the same thing. If they have false info then they have more steps to take to even find the real you. Your at an even safer position now since you have offshore backup now. In other words your in good handz my friend.:cool:
 
Ok thing here is that you better try to find a good lawyer and reply back saying you will stop using the site, make some excuses etc etc Lawyers are good at this things..

NOW, keep this domain for you! and Use it! (if suitable) for a forum, for example, that will collect people comments on that brand (hint: freedom of speech and think, etc)

- On that forum PM the members with ads for your site
- put an attractive aff. program in place and you could see sales soar in no time

have u heard of the expression. if you play with fire you will get burned!!! thats exactly what your doing lol. selling fakes is one thing but making a site aswell to sell fakes form is asking for trouble in my opinion...

They just need court order and they'll know what you eat. I mean, when I just put 1 add on the net about selling some divx movies and haven't even sold 1.. 3 months later cops come to my home and confiscated my computer, cds and stuff. But the point is that they had logs about everything, they can track you easily if they want to.
Your call but you are really acting stupid. You should now by now that everything Black or Gray hat is just a short term, so you should invested income in whitehat longterm business.

It's not that difficult to understand. Would your open your own, fake Walmart across the street from a real Walmart? At some point you would get a visit from somebody that doesn't support your best interests.

Besides that...how could you steal from Nike??? They're great! The shoes the offshore factory makes costs Nike pennies on the dollar and you're robbing them of their hefty profit. Shame on you! ;)
 
dude i suggest u talk to people who sell replicas, theres nothen worse then a bunch of peope given advice...and none of them sold replicas before, this whole thread is a bunch of he said she said, first of all, check the laws in other countries...ask yourself...why does nike allow asia to reproduce Nike's if its sooo wrong....let me tell u....because of international copywrite infringment laws...there not enforced in asia, have u ever heard of a factory busted in asia for the reproduction of nike's NO...i never in my life heard that...have u ever heard of any USA law enforcement going into another country to enforce copywrite laws from the USA.....NO! u know why, because they can't.

I'm not going to encourage u to sell replicas but, I'v sold them for 2 1/2 years so if u need some tips PM ill tell u what to do for free...so we can get the non-sense out the way.

He is not a scammer. Replicas are big business and a lot of people knowingly buy it.

So dont knock somebody, because somebody in another shoe could easily label you a scammer for blackhatting..

Also there are plenty of people selling replicas and nothing is happening. They usually will ask you to stop once they caught on and sometimes C& D letters are from competitors

I think that says it all. I used to have a replica handbag site which did very well. I eventually got a cease & desist order from Chanel.

Chanel lawyers go for the jugular, so I'm lucky that they didn't pursue. These lawyers also share your info with others in the biz.

By law, Trademark owners are required to pursue counterfeiters, or they can lose their trademark. Also, these lawyers don't care what your family situation is or that you never touch the stuff because its dropshipped out of China.

At the time I thought maybe I could slither along for a few more months, but after talking to a Trademark lawyer, I decided that it was a dumb move and I closed down the site. It was painful to do, but looking back, I'm damn glad I did.

There's a lot of legit ways to make good money online to help out your family. You won't do your family any favors having a hundred thousand dollar legal debt waiting to be paid after you get out of the can in 5 years.

I would advise you put the site up again- anonymizing where possible, including at the registrar, etc. (move it over to another host). Then 301 redirect to a new URL. Then take that old site down. Some way you need to capture that PR and inlinks you had and send it somewhere else you can benefit from. Is this a risk? Yes. If you have a LLC or corp this sites besides, you have some protection at least.
