Facebook declares war on spammers?

@OP: If you want this discussion to take a serious turn, we absolutely need to see the scanned letter. Cover up your private information.

OR, if you don't want to post the entire letter, just tell us the name of the person who signed your C&D. One of us can personally call them and make sure it's legit.

I have to wait and see if another guy gets this letter. seems the OP leaves a trace to where he/she can be mailed from.

I would be willing to pay you $20 to provide proof in the form of a scanned copy of the letter. Or, by providing the name of the signed attorney, so ONE of us can call and verify the legitimacy of the C&D.

Anybody else? Start a pool!

wow this really does bite. I was thinking of adding up on FB accounts but didn't know they were doing C&Ds. Interesting post.

As usual, when one company becomes such a force on the net, they tend to power trip. Look at google and their adwords. I'm not surprised if FB suddenly slaps users/IMers and what not in ways that google has. Looks like it's already happening.

Those projected numbers were before Facebook's advertisement platform really took off...That was in 2009, so that's the numbers you should use and focus on. 2010 is going to be even more extreme for FB as they grow, the advertisers pocket out more. You see the right hand side advertisement? BIG!

Well, I'm kind of confused why, if you know these numbers, concretely, why do you not actually post them? Otherwise I'm going to have to guess you're basing this on assumption and industry buzz (when's that ever not worked out? oh, right, like 90% of the time when it comes to web companies). If I'm wrong, I'm happy to have it pointed out to me with some sort of actual numbers. From all i can tell their revenue is up. Revenue is not profit. As the company was valued at about $14 billion in 2008 and is now, in 2010 still valued at well, $14 billion I'm going to have to go ahead and doubt that the increased revenue has resulted in a huge explosion of profit. Between 2008 and 2010 they've had gigantic increases in traffic, active members, new features, etc. All of these things, I'm sure, account for the increase in revenue. But, ya know, they all contribute to an increase in their business expenditure as well. The reason for quoting the numbers from 2008 was because FB is not a public company. Therefor it is not required to make its profit/loss available to anyone other than private investors.

Secondly, I wasn't advising someone on capital investment. The point I was making wasn't directly related to exact amounts. Unless you're trying to argue that FB went from -$150 million to making billions of dollars in 2010. Are you? Didn't think so.

Thirdly, yes, it would be dumb to ignore a C&D. But, as I didn't notice you mention it, have you much experience in receiving C&D's and the legal ramifications of them? Over the last 8 years I've received 3 from myspace and 2 more from other services. If they send you a C&D it generally means they have no real or actual legal grounds to pursue you on. You will notice that they rely mainly on their TOS agreement. Courts almost always reject damages based upon TOS unless something in the TOS is directly related to a law. A TOS agreement is NOT a strongly binding contract. Clicking "I Agree" is not even remotely the same as a signature.

When it comes to "fighting spam", specifically, C&D's are generally used by social networks or other sites when there is nothing they can really do to stop you. So they try to scare you.

Out of all 5 of the C&D's I have ever received a simple "fuck off" from my sponsors attorney have resulted in the issuer scampering off.

So, again, I am not saying someone should ignore a C&D. What I am saying is the idea that FB or any other social network has unlimited resources to pursue spammers endlessly is ridiculous and completely unfounded by facts.

FB, MS, all other social networks have been using C&Ds quite often since their inception. It's nothing new. If you're smart about what you do they're virtually a non-issue.

Should you choose to ignore this letter or continue your current improper conduct, facebook will take necessary measures to enforce its rights, maintain the quality of its site, and protect its users.

someone who understand the law here?
What can they do? I do not live in USA

More than likely they found you through your Google Adsense information.

That said then:

Facebook, a US artificial person, cannot use US law nor US courts against you. Your response would simply be: Motion to dismiss for lack of personal jurisdiction - both general and specific personal jurisdiction.

Now, what about civil claims in a court of your country or some unknown international court?

in a court of your country? If Facebook is registered as an artificial person (ie.: corporation) in your country, they could go after you in personam in your courts under the laws of your country. So research your country's laws. Let's say they come after you civilly through your country's courts? They would have to prove that they were harmed in some way by your actions. What harm have you done to them? Ok, so you violated their terms of service, what can they do? They can close your accounts and ban you from using their service again. That is easy enough. They have control of their own systems.

I agree with what other have said here. Now, I do not know what spamming you have done nor what automation you have used in Facebook. But I do not believe it is necessary to close the accounts. After all it is only a cease and desist warning. But I would stop using bots and automation. I would be happy with the 500 friends you have now. If I am making money on the accounts and the keywords integrated into it, I would protect the account with a layer of integrity. Build outside links to it from good sites; and then build links to them via BH methods.

However, you will need to make decision for yourself and upon your own knowledge and conviction.

I hope this helps.

DW

So, lets play a game called logical analysis guys.

Facebook girl is either A. Scaring off FB spammers B. telling the truth

If facebook girl has a letter, then facebook girl is telling the truth.

If facebook girl is telling the truth, then from reading your posts, your all ready to throw in the towel and call it quits.

so ask yourself this, if facebook girl puts up a fake letter would you know the diffirence and would that stop you?
