E-Mail marketing - Legal implications

Recently I started getting more and more mails which are added to my list. I'm fairly confident that over the months It will grow to a targeted, large e-mail list which can be really profitable.

Question: Anyone knows if I could get sued for that? Basically the emails are scraped and I'm very certain that other people haven't used them for spam before. The mails I'm sending out do contain an opt-out link at the end of the mail but it's still spam.
I highly appreciate insights from knowledgeable members!

Don't know about other countries but in the UK you'll get prosecuted and fined up to £500,000. Lot harder under gdpr

woah. But can the average joe sue exactly you? Can he request your IP adress by the mailing solution?

It's the regulators that prosecute, if someone complains, same with text and phone marketing. If someone hasn't opted for it, then it's illegal in the UK. Scraping from somewhere else, even the same niche doesn't make it legal as they haven't given " You " permission

With regulators you mean what exactly? How can they sue you if they don't have your information?
 
I think you can still email to generic business addresses can't you (info@ for example)?

But yea, in the UK, emailing to any personal address is a big no-no if you don't have express permission to do so.

You are right, the chances of getting sued might be low for a small time operation, but its definitely a risk and the bigger the operation (and the more profit you make) the greater the risk.

As @blogzandstuff said, it only takes a few complaints to the ICO and then the governing body may decide to take action, making an example of you.

A regulator is a legal body that regulates the industry, a lot of power. They'll easy track you down. Bit like the Mods on here lol!

Just get people interested in what you have to offer and let them opt in via your site, by doi g so they are giving you permission. Be clear and honest as to what you intend to do
 
Also keep in mind that scraped list almost always include spam traps. Just my 2 cents.

Emailing is not illegal, even unsolicited email (if you know what your doing), if you don't know what you are talking about maybe you should remain silent.

Could someone of you tell me if the following would be fine?

  • Setup a landing page which asks the user to submit their mail in order to get various offers including access to a private site.
  • Get traffic through porn re-uploading
  • ???
  • Profit
That way, the user actually entered the mail themselves and did the DOI. The porn videos itself are stolen, but I doubt that will be a problem.
