On 6 October you contacted our support department by email, Telegram and support tickets with the following request: "Law enforcement seized my laptop. Please change SSH passwords, change my VPS passwords, email passwords quickly." We can share these here, as we retained copies in case of a subpoena. Why you opened a ticket about law enforcement, or what happened to your laptop, we do not know; it appears something happened that caused your devices to be seized.

When we become aware of illegal activity, or of involvement by the authorities, we are obliged to act, including blocking access to and suspending services. A warrant-backed data request had already been served on us in advance; once we became aware, we were required to suspend and restrict access so that logs and data could not be altered or deleted. We will not become involved in this, nor act on your behalf; no hosting company will do so.

Please note that, owing to the reputational damage caused to us, we may share screenshots and details of all the sites you have hosted with us if you continue to damage us, and we may forward these data requests to the authorities once contacted.

We retain backups internally as required for past and future data requests, but we are unable to give you access to them. Under our Service Agreement, and the laws that bind us as a hosting provider, you should keep your own backups at all times - this is stated and agreed at sign-up: https://hostcay.com/service-agreement#backups-data-loss

Regarding your remark, "I would not recommend buying from this guy" - we are a team of six people, and I have not personally handled your abuse case. Our company is audited quarterly, as my colleague mentioned, and we must comply and fulfil our obligations.

You are free to visit us at our Amsterdam datacenter - please reach out for the address. I can explain the legal process in person, since you are getting yourself into a difficult position. I cannot give additional details, but by replying here we must fulfil our data request obligation to the authorities from few weeks back and follow up to provide your profile as well and any new data that may have been gathered since.

You knew from before what i was doing you said its no problem running peptide business on your hosting, but you still cancelled all my services. I checked with you before i paid for your service, but now when i said police have my PC because of economy case nothing to do with you or my services. You cancelled all my vps, domains and did not let me get a backup so i can change host. I only warned you so u can turn off vps not cancel all my services you told me you will not care about anything about my business and it is okay to host on your servers. I will be making other disputes too.

Thank you for your message. We understand you are frustrate, but we want to be clear about why we acted. We do permit the services you describe as our position has not changed: we do not police what our customers host. Capable authorities do and our policy is to respond to law-enforcement requests, not to automated reports. You agreed that you bare any responsibility regardless of what you host. That distinction is the whole issue here.

What changed was the involvement of law enforcement. When authorities become involved, our obligations become clear and we are required to act. It does NOT matter for what reason police seized your devices. You contacted us about them and so we locked your services so to not hinder a whole separate investigation.

• We had already received law-enforcement requests from Dutch and Norwegian authorities weeks before you contacted us.

• We were legally prohibited from notifying you or from modifying your services at that time, as doing so could have obstructed an active investigation hence when you reached out we had to lock it so you do not interfere. “Changing passwords, SSH etc”

• When you disclosed a law-enforcement matter yourself doesn’t matter for what reasons, you put us into a legally liable position the account was locked and the services were placed on hold because the request specifically required that, once you became aware, your services be locked to prevent the deletion of any content.

Our legal compliance is more important than an illegal store. We wouldn’t touch nor handle any sort of backups of data as per agreement regardless.

On your services and data:

• The account closure and service cancellations are the direct consequence of the law-enforcement involvement, not a judgement on your business.

• As stated in our Terms and Service Agreement, you are responsible for keeping your own backups at all times. We do not provide, retain, or restore customer data on our side.

You are free to raise disputes if you wish; we will respond to them and they will form part of the record. Our legal and compliance obligations take precedence over any commercial consideration, including the handling or release of the content in question.

We’re a privacy hosting provider not a bulletproof provider. This is mentioned throughout our service agreement. We comply to legal requests at all times and you bare any responsibility that may arise from what you host. This was mentioned to you at the start which you should of read since you clicked “I have read and agree with the service agreement” upon registering. We allow backups if from a legal law firm agency that may sue us in a civil case for not suspending your sites which allows you time to backup and move elsewhere (Not law enforcement which is a different process).

Yes, we allow backups when a request relates to a civil matter and does not involve law enforcement. Our service agreement also explains that you’re responsible for keeping your own daily or weekly backups in case something unexpected happens.

When a law enforcement data request applies, we do not alter the data or allow access to create backups. Under the agreement, you lose the right to make backups in those circumstances. I’m happy to quote the exact paragraph for you.

We’re a privacy-focused provider and only act on valid legal requests. Like every hosting provider, including those offering services on BHW, we still have to follow applicable laws.

We operate our own colocated hardware and datacenter, and we run a legally compliant business. These terms are covered in the service agreement you accepted when signing up.

I understand this isn’t the outcome you wanted, but we’ve explained our position and there’s nothing further we can add, so we’ll leave the discussion here.

Have a good day.

Reading your message sound very concerning, will move my servers from this host in any case they turn into non dmca ignored one day if they got enough passive income. you can file the dispute upload all your screenshots so people will know how this server provider works(i think its good for customer to have rights to know how a server provider works whether its a reseller or a person buying a server rack and bringing own ASN). in Seo point of view, when people search offshore server provider, google will show reviews including blackhatworld so people can consider whether to buy or no. Reading the post in short terms(law request -> suspend your server, regardless which country it is from).

Thanks, good point about the reviews showing up in Google. Worth adding: they said they would give me 24 hours before cancelling so I could take a backup of everything. Better than an instant wipe, but anyone buying from them as an offshore provider should know that a legal request means suspension and cancellation, not a review of whether it is valid in their jurisdiction. Plan your backups accordingly if you host with them.

Deal with caution with this provider.

Before buying, I told him exactly what I would host and asked several times if abuse emails would lead to suspension. He said no suspension, and promised that if anything ever happened I would get time to back up my data before cancellation.

Instead he cancelled my VPS, domains and account without any notice, refused to let me take a backup, and says everything is deleted. No refund, no solution.

I have opened a dispute and posted the evidence there. Anyone considering this provider, read it before you buy.

If he really did say that, that it should be honoured, period. Glad you share your experience.

Deal with caution everyone these people work with police and will terminate your services without notice. Scammers!

Just to clarify, “DMCA ignored” refers to copyright complaints and is civil and has nothing to do with the content involved in this case. Yes, we operate our own network, ASN and hardware.

We’ve always been transparent about how we handle law enforcement requests, and this is explained in our service agreement. All providers are compliant. We understand that you’re unhappy, but opening a BHW dispute because we complied with a legal court order concerning illegal content doesn’t seem reasonable and I wouldn’t interfere by responding

This thread is publicly searchable, and our responses are here to explain our position clearly: we cooperate with lawful requests from the authorities when our services are involved in illegal activity.

We support privacy and freedom of speech, but that does not mean we offer bulletproof hosting or allow our services to be used for fraud, illegal drug sales or other illegal activities.

If you host something that may be illegal then sure go ahead we can’t stop you but you bare the legal repercussions that may result in your activities. We’re not the police to decide what’s right or wrong we remain neutral until we are contacted by law enforcement then act. What you host is your responsibility, same goes for your data.

Your confusing general abuse emails with law enforcement data requests/warrants/subpoenas those are two separate things. I’ve already explained this in my last responses but we seams your not understanding or properly reading. If we get general abuse eg an online agency or law firm and unable to continue hosting you then yes we allow backups. If law enforcement reach out (this isn’t considered an abuse email) we will comply and unable to provide backups.

We have over 80,000+ customers 11,000 VPS servers and 36,000 shared hosted domains , numerous registrations of domains portfolio, dedicated servers and you can visit us at our DC where we colocate, we allow visits if you schedule a visit.

We’re not here to protect you and become liable for your illegal activities. If that were the case we’d be closed down long ago as an illegal business. We run everything legally in the datacenter where your services are. DMCA is a US law, other niche projects may be legal in one jurisdiction and illegal in another. We’re not here to decide that for you. If we’re contacted and have to comply we will comply. You bare the consequences of what you host.

Please read a provider’s service agreement before ordering so you understand what is permitted and how these situations are handled. It helps avoid misunderstandings and frustration on both sides. This is how all providers are bound by not just us. Whoever tells you otherwise then that’s up to you then.

This has gotten out of hands and this is final responses we will reply to. If a BHW dispute is opened yes we will continue there and provide all evidence for mods only to see as these requests cannot be shared publicly.

Before I ordered, you promised me that if anything like this ever happened, I would get a warning and a chance to back up my data. You also said that even if a request came from law enforcement, I would still be notified and given access to my VPS to take the backups I needed.

Instead everything was cancelled immediately, without any warning and without the chance you promised. That is not what you told me before I paid.

You can explain your service agreement, but you did not keep your word. Deal with caution.

No, we saved a copy of the Telegram conversation before clearing the history and blocking you. As you instructed us to act illegally for your benefit as your devices were seized by law enforcement. You initially asked about abuse reports from what I see in the logs and my colleague answered that specific question. That does not mean we ignore law enforcement requests.

Your sites eg steroxlabs.me is your responsibility at all times. We’re not in control to decide as we mentioned numerous times we remain neutral until law enforcement interferes as laws and regulations differ from jurisdiction. Where it becomes obvious malware, fraud, scams we would suspend and cancel on the first report but other projects we do not interfere unless a capable body investigates and lawfully we have to comply.

Please open a dispute on BHW so we can address this through the dispute process and provide the relevant screenshots to the moderators. We have further records to support our response, but we’re mindful that these contain private conversations.

As explained in the service agreement you accepted when signing up, you are responsible for what you host, your backups, and the consequences of your activities. We do not promise advance warnings before taking action concerning illegal activity. An abuse report does not prove that illegal activity has taken place. Abuse reports can be fake or automated which we can disregard as we’re not the proper government body to handle such sensitive cases as that’s when we said could allow backups. Whereas a law enforcement request does.

Your services were cancelled through our billing system. Access to the associated data and logs remains restricted, and these records are being shared with law enforcement in accordance with their instructions. We cannot override those instructions.

Please stop misrepresenting the situation and take responsibility for the unlicensed drug-related stores you hosted and the circumstances that led to this action.

I have screenshots of the Telegram conversation where you promised me 24 hours to back up my data before any services were cancelled. That promise was not limited to abuse reports. You also told me that law enforcement very rarely contacts you.

My sites were behind Cloudflare and other proxies, so it was not possible to identify you as the host from the sites themselves.

You cancelled everything immediately instead of keeping your promise. That is the only point I am making here. I will not discuss anything else in this thread.
