Fan Page shut down by some idiot [help]

Hey guys,

Like my description says my friends business fan page has been shut down which I'm also connected with. The reason they have complained is to do with the branding of the logo, but the logo is legit and has not been copied in anyway as it was hand drawn and designed by my friend. This is the message facebook has sent me:



I then tried to contact the complaining party and has not replied after 5 days now, this is affecting the business as the website was just about to be launched and the followers notified of the website.

The company sales clothing lines for example fitted hats, jumpers,jackets with the branded logo and was all being sold through the fan page but would have been better as we was about to launch the site and drive the followers there.

I did a little research on the person as the email and full name with surname is provided, and this is what he does "deals with all intellectual property law issues, commercial and contentious, with an interest in technology, copyright and digital media". My guess is that somebody complained to him and he contacted facebook.

I've tried contacting facebook about this with no reply and message this person on he's website,he's linkedin and direct through he's email but he still is not replying. The company can not go forward if the fan page is not back up.

What do you guys suggest I should do and has anybody dealt with this type of matter before.

Actually sorry its not on the logo,my friend just told me its to do with the company name, apparently there's already a trademark for the name but my friend actually owns the registered LTD, from what I understand you can't claim a trademark on a legally registered company name.

Take your time, try not to rush the complaining parties with emails; this can hurt your chances of getting the Facebook page back. You can work out a deal that you will change the logo in exchange for the page back.

Should I wait for them to reply?. I'm worried that he has no intention in replying, also they havn't mention what is wrong with the logo,and if we try to change the logo it would hurt the business as there have already been bulks of order already been made as the website was ready to be launched.

The fan page had 8K active followers and always purchased direct from us, the business was only selling within the UK and was expected to start selling outside once the website was launched.

Thanks, just a lesson learned not to put all your eggs in one basket. Never expected the fan page to go down when you are actually doing legal stuff.

Just wait a day or two after each email. Also, try sending from a different email address, your current email might somehow be blacklisted.

Selling entirely off a fan page is risky for this reason. Invest in thae long haul and get ecommerce website running complete with seo. If your followers are still genuinely interested in what you are offering they'll find a way to get it. Make appropriate changes and start up another fan page (this time only to point to your website). Sadly I've had fan pages banned as well and from my experience the chance of getting them back is little to none.

Thanks guys, I get what you mean but we didn't expect the fan page to go down specially when you are doing legit stuff, the company is even a registered LTD. Were planning to file some case over this as the complaining company is claiming trademark, and from what I understand you can't claim trademark over a legally registered LTD.

go ahead and do so, it there's one thing facebook considers and takes action is this sort of complaint they don't bother to check if allegatons are real or not, they just take action and then if the issue goes further they attend the matter as many people use this sort of methods to take down competitors, and most people don't do anything about it for lazzyness

Thanks, yes it really sucks that it would be that easy to take down somebodies fan page who has worked hard for it to build. You would expect Facebook to do a little research first before taking down a page,I mean cummon now there's allot of businesses who use facebook to sale their products,and if its that easy to take somebodies page down,soon enough businesses won't rely on facebook to trade or advertise,shouldn't facebook aim to be one of the reliable places to start your business and look after the businesses that are doing legit stuff. The fact they don't help in anyway with the situation has lost my trust in using facebook in anyway for business.

That looser will not respond to your request. You can sue him if so advised by your legal counselor, and in the same time build back your fan page.
If he has social accounts promoting his website do the same he has done to you.
Send a complain to Facebook(and other social networks) that he uses a registered trademark.
You can also make more than one Facebook page promoting your business. Make fanpages for some of your products and add your followers to each of the fanpages.
