I agree with a lot of the other posters, blanket statements regarding EMD and penalties are nonsense. Overall, Google is trying to penalize spammy links that it determines by a number of factors and its approach is more subtle than that.
Right now I have a little experiment going on an age Apple branded EMD site. Just before Panda I sent out a very spammy SB blast with good comments, spinning and quality IP addresses. It remained on the second page but once Panda hit it started to rise to the first page. Since then I have did nothing with the site waiting for my big fall campaign. To my amusement I have watched it go up and down in the SERPS on its own as the each Google update hits. Just recently it fell to the second page and I said okay that makes sense.
Today it was back on the first page in the sixth slot. Go figure!
