Wow, what a scene. I am confident ExtremeSeo is correct, WordPress and commercial code has always been an issue because of GPL. Legally he is probably right but it is a pretty shitty thing to do. WordPress main dude Matt has had some issues with paid products like Thesis for example. Once something is GPL pretty much everything derivative of it needs to be and WordPress is in fact GPL.
 
VERY important thing :

To be sure getting your refund, don't accept an upgrade of his tool.

Because he can say as you have accept the upgrade: "now you can't sue me."

EDIT: "ExtremeSEO: Unfortunately, due to the nature of the product (a digital download), refunds cannot be issued."

That's what i say previously

But his funds will be blocked for 180 days and with so many claims, paypal will refund people

Any member here would suggest me how to take his site rankbox.me down? as i am sure now there's no chance of removing my code from his plugin.

Easy one. He registered his domain using GD. Just contact them with all your evidence of his illegitimate appropiation of your code. Just let them know you are aware how they are a company that doesn't hesitate to stop abuse and fraud, and make sure you emphasize the word fraud. It's like giving them a wink so they can go ahead, suspend the domain and add charges to his account for his fraudulent use.
 
so should i do a chargeback? (I guess i have to call my credit card to do this) or just let the open dispute go through?

If you were to call your CreditCard company and issue and unauthorized transaction/payment, you should get it back.
 
I would be calling my credit card bank right away; PP dispute can take some time and the CC company is more likely to handle this much more quickly and is probably a better bet for you anyway.

just got off the phone with credit card company and they said the charge is "pending" and in limbo so they can't do anything now, i have to wait a few days for the charge to go through i guess, and then they'll issue a chargeback.
 
I don't blame you for approving the BST, not like you had carsons's code to compare it to at time of approval!

ExremeSEO's thread would have never been approved.

I approved ExtremeSEO's sales thread. However, until
carsonrathi came forward this morning, I was unaware
that ExtremeSEO's tool was a straight out rip of carson's
tool.

I do hope that those of you who paid for the product
get your refund back. It really sucks when something
like this happens.

i'm gonna turn this around and blame carson...
he basically has a kickass plugin and he goes and sells it to WF first!
*sigh* so sad to say but this could have been avoided if he sold to WF and BHW at the same time.

Honestly, I really don't like un-happy customers. Please understand that if I were to just offer an open-refund policy...every blackhatter would take FULL advantage of it. Let's have a truce. I would be willing to give you a 50% refund and 2 months of Blackhat Hosting - and then this stays between us...otherwise both legit and NON-legit people will be begging for refunds and it's impossible to tell them apart.
By the way...your account is still fully active and will continue to be.

This is the response I got from him when I requested a refund and filed a paypal dispute.

In Linux dev I have heard this crap for years. If my software runs on LInux, and the kernel is GPL, then you have to release it under GPL too. Fud you! For one, the only way to be a derivative work, is to use the WP code in your software, aside from hooks, that are specifically designed to enable other developers to create "add on" "extensions" for WP.

What you are proposing is that because your house has a face on it, and a door, that when I build you stairs and a front porch to enter, you then have the rights to sell my architectural design to your neighbors, and you feel that you can obligate me to turn them over, just because you already hold the plans to the house you have. This is intellectual theft, as well as developer blackmail.
 
@ Lanx - Trust me, i'm not taking the deal, I want a full refund...you can't be stealing from other bhw members like that!
 
I did not buy this scambox but i'm happy to see that mods are taking this kind of actions seriously and up on that acting fast. Makes me feel comfortable here on bhw and beeing a donor.

I'm not proposing anything, just stating the facts. Running on and derivative are two completely different things. It has been an open issue with WordPress for ages, don't know of any formal challenges though. I do remember Matt (WordPress) pulled Chris Pearson's themes from their repository because he sells a commercial theme (Thesis) and they think it is wrong because of GPL. I don't know of any WordPress related legal cases but GPL is very clear about it.
