I was given a chance to review Extrawinners hosting free, and it is really good. The servers are lightning fast and the price is great.

Cons:
US Based - I don't know how he can stay "under the radar" but apparently he can, this still makes me kind of uneasy
I'm also worried that he is doing too many promotions and underselling so he won't be able to make a good profit for himself lol but that's good for you

If your ignoring DMCA and are hosting in the US, your asking for a world of hurt. Regardless of your hosting provider, it's your responsability to remove the offending content or you no longer recieve the safeharbor under the law.
Meaning you CAN be charged for copyright infringement, and big companies will supeona your domain records or anything else to track you down. They can even ask for assistance from the government, and have them launch a criminal investigation and have a warrent issued to obtain your server(s).
It doesn't matter if your HOSTING provider turns a blind eye, and doesn't enforce DMCA requests... The host is still in the US, and as such your responsible for complying with US laws.

Thats great, and hexalor is a great guy and I have talked to him on numerous occasions. But the LAW is very clear in the United States at least, and if you choose to ignore DMCA requests, than as a webmaster you no longer have the protections afforded you under it.
So again just as hexalor and you have both vouched "if you fail to protect a website, you will refund the money." However, no one is going to care about your $40 refund, when they have a pending lawsuit and could face criminal charges, fines over $100,000+.
Let's face it you've been in business for what a couple of weeks now. If it ever came to the point, where your datacenter received a warrant to turn over your servers. Do you really think they are going to risk being handcuffed and going to jail, just to protect you?? Of course not!
Staminus is a great datacenter and DDOS host, but at the end of the day they are still located in the US and still have to observe US laws. I'm sorry, but those are the facts. The spirt of the law is very clear cut, there is no wavering.
PS: So before you tell people that their Movie site, which is linking to copyrighted content and is therefore engaging in contributory copyright infringement. At least they should be aware that if I.C.E. the Marshals or anyone under the Department of Homeland security. Chooses to go after them, as has happend in the past couple months, when several major US Datacenters have had to turn over servers, because there was a warrant issued by a US judge to confiscate them as evidence, and shortly thereafter they had agents knocking at the webmasters doors. They should just be aware. It's a US host and not offshore, and as such regardless of what you choose to turn the blind eye against, still can have reprecussions for your customers.
PPS: You should also take other forums of payment, besides Paypal. Liberty Reserve, egold, are all good options. Basically you want a provider that can be reasonably anonymous for your payers. Paypal is not an anonymous payment option. Just saying if you want to try for the whole "quazi/offshore" but really US based hosting route.

I've been working with ExtraWinner to resolve these issues right away (was one of the first buyers) and something has happened on his back end (DC controller related) and I think the dude has been up for 24 hours now. We've been PM'ing back and forth but technical errors do occur. I have hosting at 1and1, HG and also xsserver and have had outages with all 3 so let's not judge the service just yet okay?
