Will I end in Jail with my Instagram service?

Hey guys,


recently I reached the first stage in the development of an instagram analysis tool. I’m quite sure that I can offer in depth analysis that go a few steps deeper than existing tools like hypeauditor or socialblade do.


Deep social was shut down in 08/2018… but i cant find any information about how they were shut.


I’m thinking about how to design this business modell not to end in jail.

Of course I injure Instagrams terms of service, like all the other insights/bot tools do...

Does some of you has experiences with instagrams lawyers? What do i have to fear, if they notice my service? I live in germany btw.

Oh germany... (besser nicht). No Imprint. No german adresses. Of course you can get a "wettbewerbsrechtliche Abmahnung" in germany ended with a "unterlassungserklärung". Not the best place for this! Better go north-east of Europe. Estland, Ukrain and build a company there with Bankaccounts. In germany it will be veeeeery expensive, but no jail of course - its all about the money here

Don't do it (if you are trying to do something that breaks their tos) if you don't have deep pocket, because fb surely has deep pocket.

I don't think this will lead you into jail. The worst they will do is trace your account and disable it. Think of it, how many thousand of people out there are trying out new ways to outsmart Instagram? Countless! If you are still very concerned, I think you should use vpn.

As far as I know based in US law, you will only go to jail if you do a criminal offense, so if what you will be doing will expose people private info (like what FB is doing and is facing criminal charges as we speak) or if you are doing any porn, child stuff so that is going to be a problem.
If you are only creating an app as a pot to post and follow .... whatever then that is not a criminal act

Pretty sure you will get a cease and desist first before you are sued, unless are spamming the hell out of Instagram.

Rule #1: Don't ask a random group of anonymous people for legal advice.
Rule #2: Ask a local lawyer about the laws in your country for whatever it is you intend to do.
Rule #3: If you can't afford a lawyer, then you certainly can't afford defending yourself if you ever do get sued or charged with a crime. So don't do it.

I am not sure how Germany treats TOS. I believe the EU does not consider them legally binding. The US, has recently treated them as such and prosecuted people under computer hacking laws. but that is the US. The EU are more lenient. As you are not defrauding (i..e botting spotify plays to generate payment is fraud and illegal, botting a counter to give your account a higher number is not fraud and not considered illegal (not including the US).

However, best to speak to a German lawyer if you want to be sure.
