i no for a fact, if a image looks the same as a branded image , it can be ordered to be tacken away via the branded owner , can also lead to a court case .
images that are altered or made to ""look a like "" to a existing brand can be classed as copying the brand image.
i am only pointing out what i no , maybe your image is near to look like a already looking branded image , you still got the rights to fight your case, but can cost loads of court fees...
if you can compare the branded image together and it defently looks like the branded image even thu it diffrent , the courts will order you to remove all images from everythink you own.
but if you got a good lawyer and designers and convenience the court your image does not reflect any relevance of the brand image you could win and get awarded copywrite status. (( you then have to sue for all damages and court case fees))
a brand in court dont work like a stright foward copywrite case , a brand is seen as a whole storey , and if that storey can be effected via it image the offended item can be removed .
a copyright stright case is about a image being the same as another image , but by law if a pixel is diffrent from a copywrite image it now diffrent and legally new.
as you can see, a brand has more weight over copyright issues.
a brand will be very advertised and thousands spent on advertising to be popular , maybe the brand also been around for many years and the image mean somethink to the brand from pass, it all add up as a storey.
