Trademark in domain, question

Hi,

I have an adult domain with trademark in it.

The website gets about 6-7k daily UV. Earnings are pretty good.

Other websites in my niche also have the trademark in the domain, and the domain age is older than mine. I'm considering to sell the website and domain, but not sure yet... just not to have to worry about a legal issue.

What would be the legal issue considering the domain has a big trademark in it?

Obviously you or any of the other site holders have never been contacted by the TM owner... the buyer would be assuming the risk that they could be required to hand over the domain name to the TM owner at any time. If you do intend to sell I would make that abundantly clear (probably in writing). To sell it you may have to document the other sites and how long you have all been in business. Do you think the TM owner could pop up in the near future?

Yes, I think so.

Another website, with "Pokemon" in domain name, just got taken down by Nintendo.

Yeah but Nintendo is a big company that has lawyers dedicated to just trolling the internet and finding/taking down TM violations. Additionally Pokemon is a current (fading) fad so they are on top of it) Is the TM owner in your case a big company? Or a small business, online presence? Is the TM owner active on their site? Does the TM owner do the exact same business as you or a variation?

It all depends on the TM owner and what they want to do or not.

It depends how big that company is. If they are a big company and have a history for this then i would say sell them if you can else drop.

Yes. I think the Trademark owner is quite big. It's "Blizzard." I've read that they are taking down the adult website with trademark issues.

You can sell it but expect to be payed less than a regular site. Just like warez sites are sold at lower times their monthly income because of the risk of being taken down.
