Check for trademark. If no one has trademarked your brand, you own the brand.
If they have, and were too stupid to get the domain, tough. They are out of luck. As long as you don't try to pretend to be them, you are OK. (trademarks are by product class and there are hundreds of classes)
You own the domain. You have the brand.
If someone trademarks your name tomorrow, you could care less as you are "grandfathered in"
Corporations are state entities. It only matters the state. "Starships Inc" in California is a different company than "Starships Inc" in Florida. they have nothing to do with one another. First come, First Serve.
"DBA "Doing Business As" is a state permission. You pay to use the name in a state. First come, first serve.
You usually only need a Corporation / LLC + a $15 local business license if you have a business presence (like an office, office share, work cube or virtual office without the "virtual office" name in it) if you want to build credit lines for your business.
Without a corporation/LLC and some kind of office, you probably won't get a DUNS number.
To build credit lines you will need to make a $100 purchase per month and pay it off promptly for around 3-4 months for them to report it to Dun and Bradstreet. That is to build one line. Read the posts at the Credit Boards forum to see what companies are easier to deal with.
There are some books about this on ScribD.
Some people do this as a business. A corporation with 5 credit lines usually goes for at least $5,000 (with no revenue) or more depending upon what additional things it has (website, book, product, etc.)
