If it were me I would not refund especially if it was stated clearly before they purchased it. It's people like that who need to learn how to read before buying items. Some people also think they can always have their way and I can't stand people like that - not saying he is one of them.

Did he state why he wanted the refund? Did you sell an ebook? How often are you asked for a refund on that specific product?

LOL at him scaring you about a non-existing internet sale law! Serious dude... How could you take that seriously?
 
1. There's no such law, not in the US at least.
2. Nobody hires a lawyer for a $5 refund.

I've had customers sue for fun, specially the filthy rich ones who spend $100k's every year on legal fees anyways and couldn't care less about a few more $1,000s. For some of them it IS the principle that matters most, and as your customer stated, he feels wronged by you. So watch out.

Also be aware that in addition to a civil lawsuit he can appeal to a district attorney looking for publicity in an election year, and guess what? You may be indicted for internet fraud, etc, depending on the laws where this customer lives.

My advice? Swallow your pride and refund his 4 bucks NOW. In fact, make it $10 bucks even, and take that as a lesson learned. You will sleep a lot better, believe me.

Then make sure your TOS is bulletproof, because in many places a simple "NO REFUND" notice will mean nothing in court.
 
Are You sure that you even had a relationship with the customer?

You can just as easily reply that you do not have a return policy on your goods and services, and in addition, if this is pursued, you intend to counter-sue for commercial slander as well as legal & "research" expenses, in the excess of over $10,000.

Then go on and explain to them that a full inquiry will be made into the matter, as you feel that this might in fact be an illegal email communication with the intent to mislead and misappropriate funds. If brought to court, we will need to be reimbursed for this research and legal costs due to YOUR NOTICE.

If you feel that this matter is indeed in need of addressing, you can forward your ISP and IP records for validation to: Legal Dept.

If there is no response, then you release all obligation of claims made in previous correspondence. more bla bla bla.
 
If the buyer agrees in the terms before paying, you can just ignore him.
 
No lawyer is going to take a case of $4.62 dispute. It would be stupid as feck.
 
He didn't go to PP for a refund, he didn't do a CC charge-back, he says "his lawyer tim" whoever... a nameless non-existant e-lawyer. IMO, he is a noob trying to be an online smartass. Ignore him and move on towards your goal. At the most, tell him that you want to speak only to his lawyer. He will e-evaporate immediately. No one will sue someone over a less-than 5 dollar e-product.

I'm not a lawyer but fukkk the law, I'd always deal with such punk according to what my mind tells me to tell him first, or flush his e-existance down the L00.:)

If there is a clear no refund policy, I wouldn't give him a refund. PLUS if he's pulling stunts like that he's probably found a really great way to get free stuff online by doing it to everyone. No refund, if that's the policy. PERIOD.
 
Now this is what you should do.

Email him back to this thread so he can see how scared you were over a refund of 4.62. I guaranteed you that after he sees this thread he will laugh his ass off of how gullible and stupid you are .The guy would get a good feeling from this and will make his email look like it was worth it.

After all only a crazy guy would do that, he just did it cause he doesn't like the fact of getting ripped. Once he sees you are scare , that would be more than enough to forget his 4.62.

I hope you are ready to lose a lot more than $1 in order to achieve your millionaire goal. This world isn't one of the fairest ones out there. You need to learn to lose lots in order to gain, and often when it comes to big bank it does come with unfair loses, unfortunately.

Although we have a strict no refund policy due to the fact that it is a digital product we do make considerations on a case by case basis.
After careful deliberation we have decided that you are entitled for a full refund as you the customer are very important to us.
Therefore after a small processing fee of $4.61 usd. We are happy to refund you in the amount of $0.01.
Please respond back with your full name, address, and telephone number. A check will be mailed to you within 4 to 6 weeks.
 
if your wording is clear then they would'nt have a leg to stand on anyway tell them to knock them selfs out and bring on the internet fraud case
 
why shud u care abt 4.62$ when u have threads like 250$ and 800$ a day :D
