Please Help : Emergency : Am I into serious Shit?

Thread's title is misleading, since I thought it's very serious, but since some senior members has put some sense into me, now I feel like SHIT! I am sorry for the stupid title...apparently my situation isn't as serious as I thought it would be.


alright guys, I've been selling some products for a few months and never had this problem before.

So I have this product which has no refund policy, and some person bought it for $4.62.

Now the person's asking for a refund and I simply said NO, because there was no refund policy.

Now, I got an email from the person saying this,

"Me and my lawyer tim sayer will file an internet fraud case monday morningthat $4.62 product will cost you $5,000 for lawyer fees and court cost...
If you think I am joking your DEAD WRONG!!!. It is the law to give a 30 day
refund grace period to anything you sale on the internet..LOOK IT UP! I WILL LET
NO MAN OR WOMAN STEAL FROM ME!!!!"

How can they say this? Is it true? If you were in my situation, how would you deal with it?

I'm not that savvy on that matter, but if you stated a no-refund policy in the terms of service before selling the product, then they shouldn't be able to take such actions against you. Then again, that's what I think. I'm not even near to being a lawyer

Do you really think someone would pay $5,000 in court fees (remember, the Prosecution has to pay too!) over $5?

Ignore it, the worst they can do is a credit card chargeback.

No, the vendor's policy is the only policy that matters. If they're feeling buyer's remorse, they can't take that out on you, especially if you've got a no refund policy.

People don't read the fine print and then act like it's irrelevant just because it inconveniences them.

I hate people like that.

I wouldn't worry the most they could get if they win the case is $4.62. Don't lose any sleep over it, just don't reply to any E-mails from them ever. I have been threatened to be sued dozens of times.

Please stop the misleading Thread titles. The only way you would ever be in "serious shit" over $5 is if you walked into a bank with a gun and demanded it from a bank teller.

You have it in your signature than you are going to be a millionaire in a year. If this is true, stop wasting your time on the little things. ie disputes with asshole customers over $5. Your time is worth more than that if that goal is realistic.

Here in brazil theres is a refund law, but it's 7 days

If you clearly state "no refunds" and you have this in your terms of service,
you have all the legal doc on your site like privacy policy, disclaimer etc

Then they have to abide by your terms of service. but if you don't have
them then you may be in trouble. Any shop that has signed with
"NO REFUND POLICY" in most courts they overide the consumer guarantee an
the onus is on the individual to both see and read them and abide by them.

Also to note that the Consumer Guarantee in most countries covers and is for
tangible goods that are faulty - so they are more replacement policies.

The fact is you always get bums like that that buy, and no matter what you have,
they want a refund. I have sites with no refund policy and still get
asked for refunds.

I give the refund as "sometimes" (depends how they ask) it is just better
for business. But nasty asses like that I actually mess with - because mostly
they are full of shit and are just trying to blackmail you.

As for 30 day law - depends what country or state you live in. And I
suggest you look it up - it's not hard to find out. {I am NOT a lawyer so the
normal disclaimer bullshit, seek professional advice etc}

In short I would give him a refund and post his email and name so everyone
can beware of them, as some do this for a living (god bless the US where
some sue even the cat to make some money)

BEST ADVICE: Don't stress about it! Not worth letting one blackmailing slob lose your peace.

I have been here a few times and they never go through with it. He will speak to his lawyer and the lawyer will say YEAH lets get the bastard. He will get all excited send you the threatening letters like you just got and feel good about himself. Then in 7 Days he gets the lawyer bill for $150 for the 15 minute conversation he had with the Lawyer and will decide to cut his losses.

However for $4 just give the guy his money back.. seriously!!
