In my research before sending cold emails, I could only come across this as a solution, to explicitly give them an option to opt out of receiving future emails. You can never be sure in case of cold emails as the laws are different for different countries. I didn't face any problems in sending out more than 200k+ emails.

You can still create a custom audience using these emails, not from a brand new ad account though. The cost depends on number of emails. 1000-2000 members groups don't give out too many emails. The bot only extracts from those profiles that have their details public.

Update
There's a new update by facebook which logs me out of the bot every few minutes. This means, I can no longer scrape Pages as they take a lot of time.
Groups can still be scraped but groups bigger than 200k members can't be scraped completely now. In short, extraction has become difficult.
As a result, I'm revising the prices as follows:
1-25 k emails : $5 per 1k
25k-75k emails : $4 per 1k
75k-100k emails : $3 per 1k
100k+ emails : $2 per 1k

Pretty rare I throw down a review this quickly on something from BHW. These lists are worth it. Purchased the eCom list above thinking at that price its likely to be mainly bounce backs, but probably still worth the low price tag. In my first email blast to only 39 contacts I got 3 responses (1 of which is converting at $300 margin as we speak), and only 3 undeliverables. I wrote a non-personalized email from a female account. Excited to see what more it can produce.
