This is a good thread and not condoning "spam" per se'... after reading some email threads yesterday I looked at the Can-Spam laws.
I am by NO means and expert but what I got from reading (1 day mind you) is that you cannot have commercial intent or try to serve them up content from your website if it was unsolicited email... They wording is tricky but the fact that they have specifics tells me it IS ok to send unsolicited email in certain situations.
I think aftershock has a good approach basically telling them outright hey opt in with me etc... So a possible tactic would be to send the list to a free product (no commercial intent/no website content) in exchange for them opting in..then you have a list that gave you approval to email them.
Sure it cuts your list way down (as some will not go for it) but at least the ones you have will not consider you a spammer.
