is my website penalized? need some help here

Hi,
i'm new to SEO , so i will explain the situation to you and tell me what you think,

I have a website that I was promoting with Google ads from the beginning, so I didn't do any SEO efforts, now I want to work on that,
the problem is I found it on Lumen Database, DCMA notice from 6 months ago, (Allegedly Infringing URLs: 1 , the homepage) selling copyrighted content

will it affect this website in future? is it better if I start with a fresh domain? (although this one has some age and is known to my clients)

I got no Notification on GSC or email, the website status is like this :

weak DR (no follow backlinks)
Age: 10 months
ranks in 13 keywords, position between 28-100 , homepage ranks in 28 and 29 | KD is between 8 and 31 on semrush
can appear on google when using "site:" | homepage crawled 3 days ago

Google tends to act on multiple DMCA complaints rather than a single issue, but it could be a flag for future scrutiny if the site is accused of infringing again. I’d keep the domain but focus on building quality backlinks
 
Doesn't look like it's,
DMCA complaints/removals won't cause any penalties, they will only get your urls out of the SERPs,

If you're trying to rank the homepage and it's removed due to copyright issues, that's a different problem,
You might want to change the homepage url ( like "/home", "/homepage", etc...), file a counter-notice or whatever solves the problem

Since your domain has some age and is known to clients, don’t rush to start fresh. Try to resolve the DMCA issue first. If it keeps causing problems, then consider switching domains, but if I were you, I'd keep the current one still.
