Google's entire business model is based around scraping millions of websites then cataloging and publishing their information.
This takes up bandwidth on every site it scrapes. I don't know for sure, but I would wager that the collective bandwidth that Google spiders (scrapers) uses on all of the web servers around the world is astronomical. I don't see how Google could win a case trying to sue a company for having similar business practices as their own. They don't get to win just because they have more money or because they use a gentler term like "spidering" when what they're actually doing is scraping.
