How has Scrapebox not been sued by Google???

I guess Google is more tolerant. I think its different as well, SB spamms with excess bandwidth while Facebook and Twitter bots spam with content.

Yes, but wilfully causing damages is grounds for a lawsuit.

What about trademark infringement for their sales pages? Atleast in the US, you cannot use another companies trademark for commercial purposes without their consent. Yet on their landing page it clearly says you can scrape Google with it. Simple trademark infringement, yet Google doesn't care? I find that hard to believe, they do go to efforts to deter SB use.

where do you see trademark infringement? the icons used in the middle of the sales page? i can't see them breaking any copyright there. it's not like they claim to be a search engine/whatever google holds copyrights to, stole and display/provide access to it on their website. all they provide is a tool that is capable of certain operations, like information look-up automation

The word Google is a trademark. Yes, they own it. I can use it right now because this message is not for commercial purposes.
 
Google TOS also claims you can't manipulate your SERP with PBN + fake guest post + links spam, etc.

Almost everyone in BHW do it, do we all have to go to jail?

It's only wikipedia but still

I really think people are misinterpreting me a bit. Personally, I love SB. It's great marketing software. I actually want to create some software myself of it's quality for other non-search engine websites, and I want to create a landing page and have affiliates. I also don't want to get sued, so I am so curious how they have avoided that for so long, despite targetting a huge corporation that could easily put you out of business if they wanted too.

My point is they are not calling themselves google, not representing themselves a google, not offering similar services as google, they are simply stating they use google

Their bot actually does offer similar service to Google. (As well as scraping Google being the focal point of their marketing, and the reason they have had so many sales is SB's ability to scrape Google.) SB is like a search engine technically, you enter keywords and get a list of urls as results. Similar service.

in your example you put the brand name in your domain name which you'd happen to own. it's also a different case.
I've seen someone here on bhw receiving facebook c&d for having facebook in their domain name. FB is obsessed with their rights. Fuck them. Read more on legal matters if you worry that much. if you use something that is "illegal", dont talk about it

Well in that case, this should be the last thing you worry. For the past 6 years and they don't really care about it, they have a lot more dudes to target, scrapebox should be the last in their list because there are a few more hardcore scrapers compare to scrapebox V1

Even if they get sued, you won't be dragged in imo, just churn for now. :)

US lawsuits only apply to the US. If a company is located in a jurisdiction that US law does not apply, though Google may obtain a judgement against that foreign entity, let Google try to collect. The US also has laws that forbid the execution of foreign lawsuits against American interests.

In the same vein, a debt attorney, Gregory Constantino obtained a judgement against me. I, my income, and assets are protected against judgements as a matter of law. After the attorney, Constantino, obtained the judgement in open court, and within hearing of the judge, and in fact as a part of my defense in answering motions, I told the attorney "Okay, you have a judgement, lets see you collect on that worthless paper." Gregory Constantino (Gregory M. Constantino) of Constantino Law in Salt Lake City is reduced to sending a demand letter every three months or so. That letter is marked "Refused" and sent back just as often.

Uncollectable judgements are worthless. Google knows this too.

The first sentence I think is why SB is still in business really. The last sentence is also probably true, even if they sued Scrapebox, there are other bots that do the same thing, and even if they went after them, some of them they probably wouldn't even be able to collect from, like if they live in Russia or something. So I guess they choose just to try to deter it through algorithms, which affects all bots. In a way, maybe that's smarter. But still, their algorithms can be duped if you understand them through trial and error.

Yeah probably true, it's kind of like torrent downloads, so many people doing it. So there is less chance of getting in trouble since it's so prevalent.

There is a little more to the story. Google was sued in Canada over search results for copy infringing products. The case is Equustek Solutions Inc. v. Jack, 2014 BCSC 1063. The Canadian Supreme Court ruled that Google had to take down all links to the infringing content worldwide. Google is fighting the matter claiming that a Canadian court cannot order an American company to remove links worldwide. This is tangentially related to the Eu. issue of Google having to remove personal links, but far exceeds that because of its worldwide, rather than countrywide, scope. If Google were to sue another company for a scraper, it could harm Google in that case.
