Help me find this KIDNAPPER

I always thought that if you were going take a minor out of the country, you had to have the permission of both parents, or have sole custody or something like that.

Either way, an attorney is the best bet in this situation, assuming that the father doesn't have full custody of the kid. The lawyer can start the ball rolling when it comes to a custody dispute case, and since both the UK and the US are members of the Hague Convention, British authorities should intervene (and will probably be able to find him and the kid pretty quickly) once the court makes its ruling, which will probably be in favor of your friend since the guy probably won't show up.

That's a true statement if there was a order establishing paternity, custody and such. It's part of the initial process to divorce proceedings when it involves a minor. Since there wasn't any order, he had a legal right. (In Florida anyway).
 
Thank you so much everyone for the help. I guided my friend through the channels that you guys recommended and I will be following up to let you know what happened. I am not sure on the technical details / terms so I apologize if there was some misleading information however what happened, happened.

I have already gotten contacts for a good family attorney in miami and referred my friend to her. Lets see what happens.
 
Also, I'm pretty sure even babies need to have a passport in order to get into other countries.

Was there any sort of court order ever given regarding this kid, or custody arrangements, or divorce proceedings or anything?

If this is a case of a married couple with their kid where the dad decides to take the kid with him to the UK (8 months isn't a vacation, and any lawyer/judge/cop will agree) to move there, it gets a hell of a lot more complicated, but as Pofecker said, she needs to file for a divorce and most states (not sure about Florida) will allow you to file because of abandonment. That's a pretty open and shut case right there, not to mention as soon as she starts the divorce proceedings, it's up to the judge to determine what kind of custodial arrangement is best for the kid while the divorce is going on.

The judge has to decide what is best for the kid, if he's only a year old, he won't remember much about this, and the judge might order him back immediately, in which case, the British authorities will step in.

Which brings up another question, is the kid a U.S. citizen? Or was he born in the UK, parents came to the US, then the dad and kid went back to the UK? If that's the case, it gets a whole lot messier.

Yes, they were married. I am not sure on the divorce status at this point, I will check when she gets back from work.

This is indeed a case where the couple is married and the dad took the kid with him to the UK.

The kid IS a U.S citizen, he was born in the US. The father only is from the UK and he moved to Florida (illegally), got married, and dipped with the kid.

That might help somewhat, but either way, she has absolutely got to at least file for divorce, and if she can get some money together from her parents or other family members to hire an attorney, they've got to understand too that it isn't just her son who is gone, he was someone's grandson, someone's nephew, etc.
 
Dude social media is the key start up a facebook page with the guys picture on it and postcit on facebook stating what happened etc it will spread like wildfire trust me and also do pinterest the girls there will jump on this like its the last piece of make up ever and more importantly spread and keep active!! Once an old grandpa went missing his grandchildren launchrd a facrbook page as part of the campaign and thankgod people were reporting sightings and they eventually found thexdude

As Pofecker stated... without a court order, HE has the same rights to the child as SHE does... unfortunately, Possession is 9/10s of the law... I hate to say that about a human being(the child) but thats how it was told to me by the courts where I live in the USA. He currently has Possession of the child, and law enforcement won't get involved. I speak from experience. She needs to find out where he is, then get a lawyer involved, there's resources for free legal help, if she looks hard enough. Hope things work out.

I'm happy to see she's going to take the legal route. It's probably going to be a long and bumpy ride even with legal representation, but at least someone with experience is working on it.

I myself am a single father (never married) and have sole legal and physical custody of my daughter. I'm in no means a 'lawyer' but I've been through a lot. Feel free to reach out if you have any other questions as I consider myself a wealth of information on the topic and live in FL as well.

This is 100% correct. A similiar thing happened to my friend, her estranged husband ran off with her son (hes an abusive wife beater) and there was nothing she could do about it. Ultimately, all she could do is run to a lawyer and file for a divorce and custody. Why? Because it's not kidnapping if there's no custody agreement.

I was going to say the same thing. She needs to file for divorce and custody. It's not kidnapping otherwise. She can do all this without a lawyer by just going to the court. They have advocates who will help her through the process.
 
This is one of those times where "law" is a stupid thing that doesn't help you at all. Hope everything works out for your friend.
 
Hello Everyone! I am the lady they are talking about. The one with the kidnapped baby. I was given full custody by the court.. But missing children & the cops refuse to put my ex's photo up on the missing kids flyers because they say he doesn't have a felony. I have not seen my son in a year. The only reason I don't have him is because I can't find my ex. But legally I have 100% rights given to me by the court. I don't have enough money for a private investigator.. or I would have already done so. My ex left me with a lot of un paid bills and sold off all my personal belongings as well.
 
I am legally Divorced.. and in the divorce papers.. My ex leaves me the full rights to my son. My lawyer has all this information in case anyone questions the validity of my statements. Its all true and I have it in writing.
 
In Massachusetts this would be parental interference. I am pretty sure its a minor felony.
