I doubt it. One account under my real name (which ain't the name I use here, or on any sign up anywhere on the internet - ever)

And if I had to close it tomorrow I wouldn't give a fuck. Facebook is a shit way to get traffic, and getting shitter by the day.

Actually I got it in PDF, but I am not going to upload it until I am sure everything is handled off.
You don't have to believe me :) Let me just tell you that they send it to a private email which is also my paypal address and which I never ever use for anything else than personal stuff.
They also disabled my "real" facebook account which was linked to that email. and with that real facebook account (which I had for 2 years) I have never spammed anything with that account obviously.

I'm on about the bloke who claims that facebook demanded the money he made from them back (without saying how much it was) so the next day he "sent them a check"

Yeah C&D orders are for real, the internet is full of examples of letters from FB's solicitors. They come down pretty hard

THis other bloke is different, he says they asked him to guess how much money he had earned from Facebook and send them a check for that amount. Which he did the next day.

What a pile of wank. I have no idea why someone would make up something so obviously full of shit. No company would ever do that. Facebook aren't a federal agency, they have no right to "fine"anyone. and they never have (and never will).

If a letter left their office in any official manner demanding money (illegally) Facebook could be fucked up.
It's not a "little oversight" or a "slight error" It's criminal and breaks so many rules that should a letter demanding money ever get to the press then;

a) The bloke who recieved it would have the press around same day. He'd have his 15 minutes of fame (and get his cash back)
b) Facbook would be on live news explaining at and...
c) There would be AT LEAST some very senior sackings at FB

Then the final stupid idea, the thought that anyone you owe a fine to enters into a system where you "guess the amount" and send in a check. :eek:

If the guy wasn't so adamant it happened (to the point where it's a little disturbing) it'd be laugh-out-loud funny.

Is facebook in the right to ask for it? Probably not. A lot of ppl told me not to send anything, but it was a small amount, and just wanted them to go away.

Well that's just it. They're willing to go to any extent to stop people from doing what they don't want them to do.

With their new RealID bullshit, and the merging of Facebook and Blizzard's Battle.net, i'm not surprised they're going to these extents.

I plan on deleting my personal facebook account here soon... I don't want anything to do with this creepy state they're trying to take social sites to...
 
By the way, I live in the EU and I was wondering if Faceb00k has any authority here. I mean, I've read some C&D letters delivered to European people, and they said something like "you may have violated the California Comprehensive Computer Data Access and Abuse Act, California Anti-Phishing Act, etc...", but since I live in Europe I would answer "F**k you and all your acts". Is this the right reasoning? :D
So, somebody with more knowledge can clear out if there's a risk for non-US citizens? And also, if yes, why...

Where does it say anything about guessing the amount?

How was this arbitrated? What process did you go to to decide on the amount?

How was it possible to guessitmate and send a cheque the next day? (which you say you did)

Anyway, I forwarded this to Cosgrove Manners and Hulme for verification.

Spamming: MIght be a problem if you are US citizen or have US hosting acocunt (it's an either or situation. If you come from overseas but have a US hostm they can close you host account, If you are from US yourself, they can prosecute you)

However, if you are not a US citizen, closing a US based hostin account is about all they do (obviously US laws do not apply to anyone outside the US, they have no international jurisdiction what-so-ever)

The chap who sent money to FB has been back in touch. He;s taking a very sinsible line.
FB will reject unnegotiated payments as seeming to accept them might be seen as absolving the accused party of all liabilites.

Important point. FB lawyers are lawyers - NOT a court. If you tell them to sod off, then they will have to get a court order. If you are not a US citizen it will be difficult for them (not impossible - just difficult).

There are three monetary measures that could theoretically be taken against you.

1. Damages. Reimbusing facebook for their loss of earnings
2. Costs. THe fees facebook have incurred by bringing about a case and finally
3. Punitive. More cash you are ordered to pay as a "punishment" Depending on the way this works out, some may go to FB and some to the government/court system

Copyright is the only area where FB might get a win here. OUtside the US they will never get a spamming charge to stick, because no-one outside the US has to abide by US laws (whether they like it or not)

Most countries have some level of spamming legislations, but the US have extremely tight laws. UK is intermediate, many countries have none what so ever, and if you are a citizen of one of these, and host in one of these, then you can do whatever the fuck you like. Legally.

(Don't want to keep on about this, but answered several PM's where US citizens seemed convinced that people outside the US have to abide by US laws - of course they fucking don't -you live outside US, you host outside US, abide by your local and hosting locations laws)

The copyright infringement is often a scare tactic.

NEVER send monies to a lawyer. They are independant agents to facilitate a third party to interact with the legal system, they have absolutely NO AUTHORITY WHAT-SO -EVER.

They can (and do) "ask" for discoluse and threaten legal action that MIGHT have financial repercussions for you (the same as getting a lawyers letter sent to a neighbour to get his overhanging branches cut or whatever) but they do not execute the law - they interpret law with extreme prejudice towards the side of their paying client (in this case facebook)

So a letter stating they want a list of disclosures should be met with extreme care. They can probably prove very little. They would need to cookie your site, examine your site logs, compare with their own traffic, work out who clicked what going back months.

That's probably not going to happen.

At some point FB might want to go for a landmark win (that's the way these wankers like to do it) If you are clearly small fry, it's unlikely to be you though. If they aren't going to get many tens of thousands of dollars I reckon you'll walk clean away or pay max $100.

Thank you for the info. Although I agree with most of what you said, you are forgetting something very important. First of all, they are not going to prosecute you as far criminal charges go, they will only try to sue you. Really, all they are going to do is try to scare you with a Cease and Desist letter. Also, I do not know why you are assuming everyone who is spamming FB is using one of their logos and committing copyright infringement.

Regardless, FB could never file a criminal lawsuit against you because they do not have federal jurisdiction and they are not the government. In order to be charged with a crime, the feds would have to step in, and I hardly doubt they are worried about some person violating FB's TOS.

Please...please...LISTEN: They DO NOT have to go back through your web host's logs, their logs, etc. THEY FOLLOW THE MONEY! How can some of you NOT understand this? It is so simple for them to see how much you made by forcing your CPA Network(s) to turn over your info. They DO NOT waste their time with ANY LOGS WHATSOEVER. I know people who have received Cease and Desist letters from FB...TRUST ME ON THIS ONE.

Offshore hosting DOES NOT MATTER. PROXIES, VPNs, etc. DO NOT MATTER. If you are not anonymous with your CPA Network(s), you are not anonymous, PERIOD.

Then Egay, with their deep pockets got the justice department involved who has filed criminal charges and are prosecuting it vigilantly. The bottom line is that with their kind of money, if they want you bad enough they can make it happen.

That is why I said the feds would have to step in bro. eBay got the feds involved. FB (or any other company) has no legal authority or jurisdiction to file criminal charges against you; however, the feds do. So yes, you are absolutely right when you say if they want the feds involved, they can probably make it happen. However, in order for that to go down, IMHO you would have to be doing something seriously illegal on a massive scale, and/or they are trying to make an example out of you for everyone else to see and subsequently get scared.
 
these guys do hav a loads of power but i agree with money man his points are most valid. as long as you just dont take it a to a limit where you are a very big threat to them they wont spend on getting feds in and stuff yea scaring people that is a diff story
