DUI at the McDonalds

Honestly, I can't believe some of the comments about this incident. Are some of you out of your mind? The punishment should be consistent with the crime.

To me here is the scenario: A drunk guy rammed the car in front of him at a McDonald's drive thru. There was property damage to both cars. Nobody was injured or killed. The drunk was arrested and taken to jail. His vehicle was towed. He will be charged with a serious crime and probably given jail time. (Michigan does not screw around) I believe the punishment will fit the crime.

But Clix wants to shot him on the spot. WTF! Then CPUGEEK second motions this stupidity. You two would both be in jail much longer than the drunk guy. What good would have come of the situation that you propose? A gun fight at the drive thru? You never know if the drunk was also armed.

The guy will be properly punished.
Hey, I never suggested that I (nor the person involved) should be the one to shoot him, I'm just saying he should be shot on the spot as punishment. Go ahead and put that worthless POS out of his misery and prevent him from procreating. But of course this will never happen, he'll go to court, where he'll probably do 10 days of jail or something and be sent of to carebear summer camp where they'll give him a hug and say try harder next time, like they do with DUI offenders that commit vehicular manslaughter while DUI. He'll be sentenced to pay for the guy's car, too, though he probably doesn't have insurance. And sueing the dipshit in civil court to get him to pay up would be equally ineffective, since he's more than likely jobless and/or doesn't give a shit about paying or going back to jail for another 10 days. I honestly hope that's not the case, but I've dealt with more than my fair share of worthless drunk assholes, and they should all be shot.
 
I did not mean to offend you. Apparently, I misunderstood your post. I thought you were proposing that you (would have) or the victims should have shot the drunk driver on the spot. Nevertheless, I still disagree that his actions constitute a death penalty. Nobody should shot the guy.

I am sorry to hear about your female friend. I also have been effected by a drunk driver. Recently, I lost a friend to a drunk driver. (I don't know if you consider last summer recent, but it still feels recent) He was moving to a new house before he was to get married. The drunk driver turned his headlights off at a four way intersection and never slowed down. My buddy never seen what hit him. The drunk driver then ran off in his car with his critically injured passenger still in the car. It took the police two hours to find him. Well, enough about that.

The guy at McDonald's made a huge mistake. But he still doesn't deserve to die by anybody's hand. The guy who killed by buddy doesn't even deserve to be shot. But I fully agree with the 28 years he was sentenced. Of course, he will only have to half of it, but it still is a long time.

Yeah, I'm speaking mostly out of anger. I don't REALLY condone putting drunkards to death (though, sometimes I think they really do deserve it). I'm just disappointed with some of the punishments dealt out to some of these guys who commit DUI accidents & DUI manslaughter. Most of these guys are real lowlifes and losers with nothing going on for them. I'm glad to hear the guy in your story at least got some serious jail time. Hopefully, he'll be required to serve the entire stretch. I read in the news the other day about some asshole who spent a total of 18 days in jail for killing an 18 year old girl while driving drunk. 18 days, and now he's a free man. Where's the justice these days?
 
18 days is not justice for killing anybody. That is terrible.

By the way, I did leave out one aspect of my experience. The guy that killed my buddy was already on probation for the next 8 years. His crime for getting the 8 years of probation: He stabbed......................his BROTHER. I am not kidding.

So really the only reason he received that amount of time was because he was on probation. Basically, he is doing 8 years for screwing up probation and 6 years for killing my buddy. Doesn't seem fair, but who am I to say.
 
IMO, anyone that kills another person, be it murder or DUI manslaughter, should serve at least 50 years to LIFE in prison. Take away from them exactly what they took.

The real question is did the cops charge the dumbass with agg assault? He should get locked away for a long time!!

The driver will not be charged with aggravated assault because he did not physically touch the victims with his hands (or feet, which is a stipulation of the UCR...or Uniform Crime Report). It is more likely that the aggressor will be charged with both reckless endangerment and DUI/OWI/OUIL. Furthermore, since neither victim died, the act is not considered felonious, unless this incident was not the aggressor's first DUI conviction.
