in united states in the state of new york,
would someone get arrested for sending too many private messages on a website, too many posts, too many comments

Your questions is not clear. Why will someone get arrested for sending many PMS on a site or for too many posts? If you are not spamming a community then its ok. If you are sending emails to everyone then it is must to put an unsubscribe button in footer. You even need their permisssion for sending them people.

You would have to break a law in a big way to get arrested for spamming. I doubt that would happen but I suppose you never know right?

According to SPAM laws, you need to provide a way for people to opt out of receiving messages from you. Whether that function is in the footer of an email or not matters less.

He mentioned private messages and posts, so I'd presume he'd be using forums. In these cases people can simply Ignore your user profile, as providing a footer\signature wouldn't be practical and would raise an immediate red flag even if you made an intelligent thread or reply. Besides that, if you were spamming people with PM's, you'd very more likely personally annoy people to where you would have them contacting mods to have your account deactivated and registration details blacklisted, for faster and less effectively that intelligent posts\replies.

In the cases of email spam, I simply block email addresses, as if they're sending me unsolicited emails to begin with, I'm not going to be confirming that my email address is active by clicking an unsubscribe link.

As far as commenting goes (blog commenting I suppose you may have meant) I've never heard of anyone going to jail because of that. Not even in the US. That's for webmasters to enforce, and Google to penalize when indexed.

if you send to many PM or put a lots of posts , you can get banned from the forum, US government wont come to put you to jail for this

As far as emails are concerned, you must have unsubscribe option ...to have a longer like..other wise you would find your email in spam box instead of inbox
