Cloudflare and DMCA

I see a lot of sites distributing copied adult content through websites with Cloudflare enabled.

If you check which hosting they are using then you’ll see Cloudflare. This makes sense, since the original host is hidden, copyright holder won’t be able to make a DMCA takedown request and get your get hosting account suspended.

But what about DMCA takedowns to Cloudflare? Many sites are using Cloudflare to serve copied content. There has to be a way to combat takedown requests.

I need your advice on this if I should do the same, instead of looking for an offshore hosting (that are unreliable mostly).

Cloudflare is US company.

So it can not ignore DMCA takedowns.

Maybe it will contact account holder first.

If there is no response from account holder, it might block that website.

What if we use Cloudflare only for DNS?
 
The moment cloud flare receive dmca notice, it will kick out the site and handover owner details after giving owner a written notice to remove content and contact authorities.
 
CloudFlare will hand over all details if a complaint is made, no questions asked. I have done it in the past.
 
from my experience Cloudflare will pass the DMCA notice to the hosting company, which will take it or leave it in such case,
i always removed anything in this case, so idk what would happen if the hosting doesn't take the website down

alibaba are Chinese. They don’t care about DMCA

Cloudflare hands over what appears under your domain's WHOIS when faced with DMCA. Get domain WHOIS privacy and you won't need to worry about Cloudflare.

Your domain registrar and hosting can be social engineered to hand over your information without a subpoena, however.

Don't host OnlyFans "leak" sites, recordings of camgirls, other content from behind paywalls, or morally questionable stuff such as dox. You'll be fine.

well they just provide you hosting details and not remove anything

and hosting guys also get a mail of dmca and then either we have to remove it or leave it its upto us

That makes sense but you sure about the 'not removing anything' part? Usually, China is the one banning stuff for no reason

What if uploading this type of content is my purpose? Any way to stay safe?

I think you have to remove the content once you receive a notice from your host, or your account gets suspended
 
I experienced a weird issue with Cloudflare. I received an email that some company reported my website for phishing and cloudflare flagged my website. They said that they informed by web host about it too.
It would show a warning in big text when someone would visit my website.

I host landing page created by cpa network itself. No code or file was configured or changed.

What should I do?
 
They contact the hosting on your behalf but that's all.

contact the cloudflare support and explain the reason
for some time remove it and that it after warning gets removed add it again

Will keep it short.
(CloudFlare I know you are reading).

First what is CloudFlare? Is CF CDN provider?
- Absolutely NO (free version)! Hardcache of tiny javascripts and css is NOT CDN. If you need CDN BunnyCDN/KeyCDN .

What about CF's DNS services?
- Fast, really fast for "free"

What about CF DDOS protection?
- Good filters

Does CloudFlare protect my privacy?
- Absolutely NO!, there is some "delay of expose" on their Custom paid premium plan tho.

But I'm free CF user what does that mean?
- It mean that CF will spit out your data and their own mother milk to the first complainer with FAKE DMCA complain. (They don't do a basic fact check or source check).

What personal information CF is storing and providing to complainers?
- CF keep your location IPs, your website (hosting) IPs, some basic website stats such as visitors, traffic source. If you are paid user they also have your Payer name and CC info.

Is CF contacting the hosting providers?
- Absolutely NO, they don't have to.

EDIT: Generally speaking there is no CDN provider (Content Delivery Network Provider) who can ignore DMCA due to the complexity of the network distribution.

And NO! I don't hate CF, I strongly recommend them for their DNS services.
