About An Expired Domain

I bought and spam expired domain...... but i already reported it that i'm a new owner of that site to Googleweb-Mastertool.......
And they said : that site was pure-spam, but that site already resolved ....
I just wanna ask you that :do those spam backlink affect (from the old owner) if i put the content on it???? Does google penalize me again or not?????

Yes, the links are still pointing to the site so yes it will still be hit by google

I believe the penalty will follow BUT im not 100% sure about this.
