They were distributing without a license. If the royalties for providing each song in UMG's catalog costs $.10 and you provide 1,000,000 downloads from their catalog then they have $100,000 in lost revenue from royalties. With the amount of storage they needed they were easily pushing millions in downloads each week of songs,movies,books etc.

The higher an item's MSRP the more money its going to cost to legally distribute it. $500 million may be a good estimate of the amount of lost royalties.

They were paying millions in server costs, that should tell you how much downloading was going on.

What you just did is called extrapolation.
There is no precise method to calculate the money involved, but this is good enough for the courts. It has been used before and it stands in a court of law.
 
Of course it being accessible on other websites is completely relevant. If it's not on megavideo it does not mean someone will then go and buy it they will just look else where. It's just that in a court of law they used flawed maths to justify a loss of $500 million when in reality it's a few million since most people look else where and if unable to find it wouldn't buy it anyway.

No. That it is available elsewhere, is not relevant.

They are calculating these numbers from mostly royalties.
If you calculate your losses from royalties that should of been paid to the owner of the content by the megaupload people....

then it is NOT relevant if you can find it on another site or not.
 
I'm not a double sided liar. I am willing to accept the curent laws regarding licensing and distribution mean,has nothing to do with whether I agree or disagree.

If you want to engage in that kind of activity you have to understand the risk involved and the laws. And be willing to cover your business model which means.

1. Not be a U.S. citizen
2. Live in a country without a extradition treaty with the U.S.
3. Own a foreign based tld
4. Have foreign based hosting
5. Don't brag like the MU guy did.(having vehicles with Mafia,Hacker as license plates will hurt your defense in court. As well as bragging about things in emails)
6. Know when to get out.

After making all that money the guy should have sold most of his business and keep MegaMusic and used it as a legit business.

As for my comment on having to pay back royalties and fines. Woudn't you rather settle for $20-30 million,and still have over $100 million left to start a legit business,then spend 5 or more years in prison?

Users upload copyrighted works which members can download said stored material with no payment of royalties to original copyright owners.

Second, when is the right time to stop ? With 500k? With 2 Mil ? With 100 Mil ? Or with 175 Mil like you say? It would have been too late cos they were after him already since last year.

All my vids and money gone from videobb, every file sharing website deleting multiple files and removing affiliate programs. Damn what will i do now to earn extra money.
 
what ever it may be Megaupload was a great site , It has never given me any problem while downloading stuffs.
 
This site opened in 95. And his been making 30 - 40mil a/yr for at least 10yrs. This guy is loaded. He had a bigger income than Lady GG. It boils down to this. His going to get a deal and it will probably set his career in motion again. Cause nobodies going to let a guy like this go. They will put his mind to good use and he may head up another site like this in the furture. Thats exactly what happened to the Napster dude if you remember his site was shut down. Now look at the site. Come on, this is a great publicity stunt too. Hell have the best lawyers money can buy and get off on the technicality. They all do. He wont do a day in jail or at least as we know it. This world is fucked up. Who said it all ends in Dec 21?

This is exactly what i am talking about. There should be a civilian regulated internet separate from this internet. It should also be free and not have any way to be shut off. Maybe it can run on a frequency instead of the web. I think before anything, we as the people should have organized this a long time ago :)
