EULA and ToS are contractually binding, when you hit the I agree button you have entered into an enforcable contract.
I don't think its enforcable for a contract to be enforcable ad perpetuum though, I'm sure there have been court cases (at least in the UK) that have found against that. It should either last a predefined amount of time or have get out clauses. And I reckon theres a clause in there that states the company can terminate it at any time and for any reason without giving prior notice.
I would be very interested in reading this contract. His best defence against it would be on grounds of unconscionability; i.e. that the terms are grossly unfair to one party of the contract.
The guy really should have read it before signing up, and is either going to need to suck it up or spend a lot of money on a legal team to have a court release him from it.
