I'm a broker in the financial industry in the US and I have a huge system in place for email marketing.
I'm looking for a system to do SMS / text messages cold outreach.

I've seen that the simplest and most effective way to do it, while avoiding getting sued for let's say 30k to 50k sms a month, is simply to:
1. open an account in SmarterContract
2. Create a form in your website with a disclaimer and a consent for sms marketing. (in case someone wants to sue you and you show them the page, telling them their number was opted in).
3.put "reply STOP to stop mesages" only in the 1st message of the sequence.

I've heard that this is the fastest, easiest, and "safest" way to do sms marketing for non-opted in prospects with sms.

HOWEVER, you still need to provide to smartercontract your business information like EIN and legal info.
My question to you guys - what do you think about it? how often does it really happen when someone gets sued for doing sms outreach in that way?
Am I missing something else? do you have a safer way to avoid troubles?

What platform do you use to send out SMS?

For some reasons there isn't a lot of information on the topic.

SMS messages can be sent through two ways. We will refer to them as the consumer and A2P route.

Consumer route, is the typical one where we send a message from our phone.

A2P route, is when we send a message through twilio, vonage ect.

Consumer route comes with a plethora of restrictions, including but not limited to message rate and content (Yes the messages you send your friends and family are seen by carrier) while A2P routes comes with next to no restrictions and isn't monitored by the carrier. As much as I would like to blame our service providers, they put this off for years until the federal government got involved and laid the smack down.

The federal government, along with service providers came to a common ground to use The Campaign Registry to determine who can and cant use this A2P route. The Campaign Registry is the entity that requires the EIN and company information. Services like twilio (A2P) have been loosing A LOT of money since this happened. If they do not abide by these rules the federal government (FCC) charges them a significant fee per message.

Long and short, there are services they provide "grey route" methods to send messages that do not require business information and send unlimited text messages through the consumer route, but you are at the mercy of the person receiving the message reporting the number and having the FCC taking it as far as they want.

I'm in a similar situation.

I have a legit service and have information on a lot of U.S clients that are potentially in the market for that service, that list gets refreshed all the time.
My idea is to create some sort of automatic/semi-automatic outreach system that will:

1. Send SMS
2. Call - either through a call center or AI callers
3. Email
4. Send a postcard / flyer

The system should be able to identify and use the best outreach method, or maybe run it through a funnel where if the first didn't succeed, then move on to the next until the client is removed from the list.
I am somewhat familiar with the other communication methods but the SMS part is what I'm not sure about. On the one hand, I feel like it would return great ROI and be very effective, but since it is a legitimate company I don't want to risk getting blacklisted.

I'm curious to see what other folks are doing. I btw, keep getting a ton of SMS messages from all kinds of services. Some of them get blocked automatically by spam detection on Android, but some of them still go through.

These days I am primarily getting messages from business lending and private health insurance companies, so I'm curious if they send these SMS blasts, get sued/blacklisted and stop, or whether these campaigns have any longevity.
