Exactly. black hat these says is basically being white hat. you can build links just do it as a white hat site would, progressively and steady over time.
A new whitehat site will not really have back links since the webmaster is not actively engaging in link building, so the patent is true in its assumptions how it scores back links shortly after inception.
I've seen many sites with only 50-100 back links that were built later on and spaced out outranking sites with 3000 RDS and 100,000s of backlinks.

Yes, these can cause a problem. Even manual review.
Important thing to mention is that "spike" is very relative. It can be anything.
For site getting 5 links per month it can be 100, for the one with 100 it can be 500.
I see many local services lately blasting their homepages, becoming a strong outlier and going deeper and deeper.

it seems he waited 7 weeks or so about since inception but he blasted the hell out of that.
is he still ranking high a year later?

He started link blast exactly after 1 month after domain registration.
Screenshots above is from presents time.
Next link blast he did in the end of June 2021.
Main keyword is 3M search volume and he now is stable at #2.
#1 outrank is not possible, because that site has very strong link profile - but he was for some time at #1 also. Right after second GSA blast.
Sorry, i was wrong - he has not 4k but 8k words on homepage.

Still getting high traffic it seems but he's getting gradually links discounted..
i doubt he shows up in Bing with those blasts? bing tends to deindex for blasting

As i said - site at #1 has thousands of referring domains and is very old.
That's why he was slapped to #2.
On Bing he is at page 7.
Lets analyze another site.

First backlinks - 2020-01-21, 2 weeks later - 45 referring domains at once.

his alexa rank is # 169,587 which although is not very accurate but this rank usually means about 1,000 uniques per day.

In my opinion Alexa is useless and outdated company.
Never used it for SEO.
This domain has much more than 1,000 uniques per day.
It is at #1 on 4.9M keyword.

Ok cool,
I'm always testing myself, i see tons of different approaches, some working some not. There's always a reason behind it though like hidden PBN yes or social signal to justify the burst etc.

I'll help you understand the "insanity"...
"For example, it may be assumed that a document with a fairly recent inception date will not have a significant number of links from other documents (i.e., back links). For existing link-based scoring techniques that score based on the number of links to/from a document, this recent document may be scored lower than an older document that has a larger number of links (e.g., back links). When the inception date of the documents are considered, however, the scores of the documents may be modified (either positively or negatively) based on the documents' inception dates.
Consider the example of a document with an inception date of yesterday that is referenced by 10 back links. This document may be scored higher by search engine 125 than a document with an inception date of 10 years ago that is referenced by 100 back links because the rate of link growth for the former is relatively higher than the latter. While a spiky rate of growth in the number of back links may be a factor used by search engine 125 to score documents, it may also signal an attempt to spam search engine 125. Accordingly, in this situation, search engine 125 may actually lower the score of a document(s) to reduce the effect of spamming."
This is basically saying new domains getting links too soon can be seen as suspicious by the algorithm.

So I analyzed with Ahrefs at least 20 sites with millions of traffic, 1-2 years old.
Some of them started link building after some time from domain registration - ~2 months and when they already had some organic traffic.
Some of them started link building in a month after domain registration, or even in a couple of days from it - with zero organic traffic.
The conclusion is - 50/50 - both link building methods in a time frame works.

ive analyzed hundreds of sites, from what ive noticed:
the ones that have success who build too early, build MANY more steadily later on (make up for reduced score from early backlinks?)
the ones that only wait until 3 months +++ tend to succeed and sometimes outrank the higher RD early builders with much fewer backlinks.
My theory is the ones who build too early have their scores reduced as the patent suggests "~fairly recent inception documents/websites should not have backlinks, in this instance we reduce the score to counter spamming" must counter their reduced score with many more new ones. (instead of starting as a new site would with score 0, maybe these early back links and what patents says they could be running at a MINUS score before their new campaigns later on kick off, hence sandbox?)
If you waited you'd probably rank among the 1000+RD guys with 1 high authority link every 2 weeks once you reach the 3-6 month aging mark. 6 months would be extremely careful.
Im running multiple experiments right now.
I have 3 networks, same niche, same registration and launch dates. the 1st i build only 1 high quality relevant contextual link to from the first week is doing more poorly than the others that have zero links so far.
The 2nd network i will begin at 3 months
and the 3rd network i will begin at 6 months
Slow high quality varied anchor back links.
This will show me how early is too early. i doubt at 6 months should be "fairly recent" to G

Sorry bro but this doesn't support your claim in any way, just take a close look at the SERPS and you will see that, Google claims thousands of patents a year, that doesn't mean they will use it.
