My autoblog got email for Trademark

You are just an amazon publisher but you are making money with their trademark. It isn't like you just have a link to their product on amazon, you are using their name in your titles and tags to rank for their trademarked name. Stop doing that and you are good to go.

Trust me, I am not scolding you or anything as most of us do what you are doing here. Just don't think these people are fools because this is what they are paid to do. If ever you doubt these emails are real, pick up the phone and call them. All the legal people always attach numbers etc.

She had the phone number, but my english is not good enough so i don't think i can talk with her

contact amazon and show them the letter. this has very likely happened before, yet they still let people sell their confusingly-named products on their web sites. so they should know how to deal with this issue.

I didn't do this yet, i think it's should be a good idea to contact amazon.

The issue is just with the how he names the site. Call the site "XYZ's Acne Solution" and there is no problem. The way he has it set up is it looks like he is these Proactiv people and not just some guy promoting acne solutions. I don't think they are being unreasonable here. He got caught, change it and make a new .net site the same way. It's a cat and mouse game.

I think you're right cause in some search term which had proactiv or proactive word on it, my site placed on top 10 in google search

But if i not using proactiv or proactive term how i can sold the product ?

If it's really them. Tell them to call you. Make a deal. Have them pay X amount off dollars for you to shut down your site. Cause essentially you will loose money if you just give up the site. Hope it turns out well. See if its legit.

Guys, its really simple stuff. Nobody a losing a domain name and nobody is going to jail. Change the title and the H1 tag and any other title that has their trademark in it and you are done. Your site still exists, you still make money and you find a new way to rank for proactiv. The lawyers don't want to hear a sad story about this and that, they are paid to get people to stop using the trademark. I just went through this again a week ago...took 15mins to make my changes and that was it.

I just went through this again a week ago...took 15mins to make my changes and that was it.

And how about if the amazon products had word "Proactiv" on it ?

I can change the title but not for the post since i don't have time to watching witch one had "Proactiv" word on it

This is a simple thing to figure out so people just have to lay off this issue. Jennifer Barry is a REAL attorney with lw.com so contact her and see if it is legit. You can always ignore these things but why lose a site over it all?

If you change the rest of your site to their liking, you should be able to advertise the products no problem because the customers will order them through Amazon, not you. Right now you are pretending you are Proactiv and trying to get customers to trust you and buy your product through Amazon. They just want you to stop pretending that you are them.

Agreed. The OP needs to just take out all instances of the trademark names that are not directly part of the amazon code. ie: change title and H1 tag as you say. Anything within the ad code itself is 3rd party and any issues there would lie with amazon.
