How to sue programmer?

I paid 1 programmer from Ukraine.
Everything was perfect. The project was 98% complete.
Out of sudden I think this programmer is tying to bullshting me.
Keep asking to borrow money from me. Because he need to pay money to his friend.
His wife asking him to buy a car and stuff.

So what does it matter to me?

I dont want this problem, so I just cancel the project, move into another programmer.
Even though I already paid him full + extra.
He even own me few K, yet I just said to him no need to pay then.

And now he threat me, that he will sell my code to my competitors.

I'm asking him why?

Its because I stop hiring him lol. Wtf I already paid him full + extra cash.

He already sign the NDA btw.

I got his photo, upwork profile etc

But how can I make sure he won't selling my code to my competitor?

And what are the best way to secure my project in term of law?

If you hired him through Upwork, they will act on this.

Other option is seek a legal consultation with a lawyer, but the cost to go after this person could be thousands if not more.

Im pretty sure, if he's not in your Country, you can't. I could be wrong, but yea.. Sucks to hear that happen to you. It sucks when people like you who take their ideas and turn them into reality to benefit someone, can sometimes end in a scam. Sorry to hear that! Good luck with everything.
 
Did you sign a physical contract? If not, it will be really tough to sue him like that, especially because you are from different jurisdiction.

Edit: Better try contacting upwork like @MisterF pointed out. Atleast you can get your money back and probably get him off upwork too.
 
If there's a contract and proof of payment, you can definitely sue.

Talk to a local lawer from from his city/county, I'm pretty sure you can get a consultation from a decent lawer in Ukraine for $20-$50.
 
Your issue is the main reason that when I farm out programming/coding that I use more than one person and each has their own aspect of the finished product.

It is almost impossible to hold you up like that when you do that nor does it make any sense for the coder to sell your product.

He has paid thousands of dollars for this code. How can you say its not worth anything? To him, its more on the business side of things to see this guy get stopped and doesnt scam someone else. No, don't relax, put that programmer behind bars.

Bloody hell. Talk to a lawyer ASAP.

Even if you didn't have a contract, the fact that he received that amount or anything close to it can be strong ground that he was working for you.

Project is not only code. That's the key point. For example, MS bought Skype for users not for code.
 
I don't think he is actually going to sell your code to competitors, but anyway, play his game and threat him back with legal action, just make him realize how harsh the consequences would be. It's always better to prevent the trouble. And yes, contacting Upwork staff is the right thing, this scammer has to be taken down!

I also hired a guy from Ukraine hope its not the same guy lol
 
I would deff get in contact with a Ukrainian lawyer, however in order to do so you may need a native speaker, I have a friend shes from there and may be of assistance in helping you find someone locally as her family has had business's in the country. You guys could negotiate a fee for her translating service or finder fee and if you PM me I could get you her information. I would also do as others suggested and contact Upwork they will at least ban the programmers account hopefully and if they have connections also pursue legal action within country. So I would deff go upwork first(call and email support team) then if that doesn't work hit me
