How to sue programmer?

@PinguSpy I was really astonished someone smart like you getting scammed and prepared an angry reply, but after reading the whole thread, there is actually nothing to say. You have done your best and its definitely a pretty weird scenario. The main question, How much does his upwork profile worth? If less than the amount paid then your hands are cuffed as he is ready to lose his account for blackmailing you. I would never give anyone money unless his profile worth A LOT more than what I am paying.

If his account worth more which I think it's from the stats you mentioned, then, he thought he will get away with it and pushing through upwork should get things solved. Anyway, I believe you can find another programmer, but your focus should be getting you money back. So, contacting Upwork was the right step. Not sure if threatening him with legal action will make him step back or know how much you value the code and try to squeeze you more and more.

You are definitely in a hard situation , but look at the bright side, you are one of the brightest members I have ever seen in BHW, so, no matter what happens you will always have tons of other bigger and better ideas. It's only small part and not a total loss.

I think the project and quality was great. Money is not an issue to me. My only situation right now is he threat me.

I have worked with devs from India, Egypt, Philippines, Indonesia, UAE, and Ukraine. Ukraine is by far the best place to hire developers in my opinion, so completely agree there. I will always prefer to work with devs from the Ukraine, and never again from India.
True. But you need to be careful, if they have the chance to milking you.
They will. Majority of them are greedy. This include Russian coder.

Unlike U.S, U.K and India.. not really. They still "shy" sometime to ask money from you.

I agreed, not to be racist, or generalize, but some coder from india are the worse, my code dint even work. Usually I only hire india programmer just for basic task such as front-end website developmet. Because they are super cheap.
For back-end, i always choose either Ukraine, russia, u.s, u.k and Philippine. But still that's depend on their portfolio - customer feedback, hours of worked, communication, etc



P/S Please dont tell me i'm the rich person in BHW, its funny. With the current situation, I believe i'm the broke person in BHW.
 
He has the code, but don't know how to market it. So just chill he can't. Let, your rest of work complete soon and launch.
It will take time for him to find investor.
 
As he signed legally binding NDA and on your part everything is fair and all data and correspondence is there for that kind of money $100k+ solution is (sort of) easy.

Go to a serious lawyer company (it won't cost you arm and leg) put together actually legal letter with all the facts and straighten things up for him on a plate.
Ask for code and all the work done that you PAID for and/or for a full refund if he would like to keep code/idea for himself.

Of course if needed for $100k I'd meet him in person one way or another I promise you that just to make sure that we are on the same page.

That should be sobering enough for everyone on the planet.
