I don't think cloaking in general is illegal, unless you are profiting from it and it violates the Ts&Cs of an advertising company you're using. Google will penalize you if you use this method though.

Basically, Cloaking is:

If you're not cloaking with the intention of profiting then why the fuck would you cloak in the first place...
