Hello members, I am having a small doubt. Please share your opinion.

Suppose there is a product from a brand, Like WWE and i am selling there products clearly mentioning that it is a fake copy of orignal.

[ Example WWE Championship belts and I am selling Fake WWE championship best ] It will be clearly stated that the product is fake , buy the orignal from WWE and linking them.

So, will this cause copyright issue. If yes how can i tackle this and sell my fake product.

Will they give warning before doing any actual legal action ?

Do you guys sell something like this ? How you tackle this. I hope there were no such issue.
 
No matter what you are saying you are still using their trademark or brand name and its illegal. Get yourself a wp site on offshore server to sell them.
 
You will probably get an email asking you to remove the content in the form of a Case and Desist, if you comply its unlikely they will go further.
 
It will definitely face a Strike.
Do go for Copyright things. Change the Name a Little bit and color scheme of these products in this case you may not face a copy right.
 
You can't do illegal copyright infringement even if you honestly admit what you're doing is illegal.
 
But there are many people still doing this without any issue. You have seen lots of harry potter sites selling every possible product of HP witgout a single issue. You can find fake products of any brand you think of is available on aliexpress.

How they do that. My niche is exactly this "fake xyz"
 
Depends of the volume you want to sell. IF you selling as they said WWE staff + the belts, will be less noticeable than if you make WWEbelts.com only selling fake stuff.
100% Illegal.
Also it's different if you plan to sell 10000 units/month than 4 or 6... If you plan to invest in publicity or just you are looking for organic selling.
Bigger the sell faster and bigger the will make you ass.

don't bother, you can't use a tradmark to sell illegal products, they'll come after you as you are breaking two laws. How do you intend to get sales? Why not start an Amazon affilite site or eBay?

The sellers are most likely deploying the, "Churn and Burn" tactic.

In that instance, they could care less about trademark infringement. For those sellers, they will keep selling (illegally infringing on the trademark of others) until they receive a, "Cease to Desist" order or some other legal strike from the owner(s)/attorneys of the trademark.

In summation, you might be able to stay under the radar. But, if not, what happens if the trademark holder infringed upon decides to make an example out of you? It's not likely, but you have to ask yourself that question.

It's all good until and unless they come after you.

Be advised, I know IMers who did the Churn and Burn and when they got slammed and were held accountable, they attempted to plead ignorance of the law. Remember this OP...

If you decide to continue down this path, have a plan in place, (i.e. offshore servers, stealth accounts, no net 30 days to receive your payments, etc).

yes, copyright protects the trademark itself, it doesn't matter what you claim, as soon as you use it, you infringe on their copyright
there is sometimes a grey area when you're using it for example, educational purpose, but since you're making money off of it, they can definitely sue you if they want
whether they'd actually do it on the other hand....depends on how much they care, or whether they find out about it at all
so if you really want to do it, i'd say try not let them know about it (hence posting the link to their official website might be a bad idea
 
It’s illegal, you are violating the copyright law. So, changing a brand name or color schemes will definitely work, try to do something like that instead of getting penalized by law.
