Why MegaUpload was really shut down...

Did you ever think that he is rich enough to pay someone who does have clue? Among other reasons, this seems like a pretty good explanation to why MU was shut down.

MegaBox intended to create ORIGINAL music with artists who signed deals to release music exclusively through MegaBox and/or granted MegaBox full distribution rights to their original music which was entirely owned by them.

Umm, yeah, again, not gonna work.

Are you talking about artist like, say, Kanye West or Adele or Big Sean or Gavin D or LMFO?

Because if your talking about the most popular artist today, then riddle me this Mr. Kickflip:

How would Megaupload sign those artist if there current contracts prevent them from signing any other deals?

Also, read up on 360 Deal, which were implemented close to 8 years ago. Label now not only take a percentage of record sales, but also merch, tours, and anythings else INCLUDING streaming and sales through other channels.

So those artist can't create Original music with another company if they are still under contract with there Label. It was like that even BEFORE 360 deals were in place.

Since Megaupload would essentially be acting as a record company if it intended to sign deals with the artist themselves to make Original music only for Megaupload, it would fall under the clause in their contracts of not being able to create music for any other company other then the one they are sign with currently.

Which means, yet again, COURT CASE!!

That model would work IF he went after independent artist who were not yet signed with a major, or Major artist who just recently ended their deal with majors.

Other then that, it would still not work with CURRENT main stream artist since most are currently signed to deals under the label.

This is all FACT!! Look it up......

If MegaBox had any intentions of allowing users to purchase works of music produced through a major record label, it would be done through already established sources such as Amazon, with MegaBox acting as an affiliate of sorts.

Just wanted to quote this again. Once again, it would have no choice but to get in bed with Majors FIRST (I said that earlier.)

But first, they would want thier money back. So now we are back at square one.

Hmm, by mere coincidence I am sure, the sites 7digital and Amazon also have 30 second clips of all of the songs they have for sale available to stream by anyone visiting the site.

Again, in bed with the Majors. It would not be that way if they were not......

MegaBox would only pay artists for downloads of songs they have complete rights over, entirely owned by them.

Ofcourse. But again, artist have no rights over songs made under contract since, once you sign with a Major, they take the copyright of ALL music made within the time your under them. So again, until they are out of contract, that would not be possible without lawsuits.

Try Again...

Ofcourse.

But he's not rich enough to pay for all those copyrights.

He is rich enough to start his OWN label or record company however. I can't argue with that.

But he can't use establish artists material.

Let me spell it out for you:

E-x-c-l-u-s-i-v-e D-e-a-l-s.

MegaBox would NOT try to sell music directly from any artist under contract with another record company. You are insulting Kim and quite frankly, you are insulting the rest of us that you think we actually believe Kim would be so stupid.

Kim would target unsigned artists, or artists whose contracts he can purchase, or who are close to their current contracts expiring etc.

MegaBox would be getting in bed with Amazon, not signing any direct deals with major record labels. The major record labels can't afford to kick amazon to the curb and anger them.

MegaBox would show artists that it is possible to make good money independently, and artists would sign with MegaBox instead of renewing their contracts with the major labels. Thus eventually forcing the Major Labels to change drastically, or let MegaBox control the music universe. Either way, Kim and the rest of us normal people win.

Nobody mentioned anything about Kanye West or Adele releasing music on MegaBox. If they are under contract, they wont be able to upload their music to MegaBox. They will have to wait until their current contracts expire.

You just aren't getting it. You are completely missing the point of MegaBox and how it would work.

LOL Kickflip, I'm normal too dude. Just disagree with the way you guys are seeing this....

Anyway, this is Fantasy, as there is not a example out yet which shows that this has a slim chance of success without a major.

Also, what you are talking about is essentially CD Babys blueprint (selling independent artists music), the only difference is that Megaupload has more constant traffic then CD Baby, so that would be the only thing giving it an edge.

But ok lets take you "independent revolution" to task.

MegaBox would show artists that it is possible to make good money independently, and artists would sign with MegaBox instead of renewing their contracts with the major labels. Thus eventually forcing the Major Labels to change drastically, or let MegaBox control the music universe.

Oh my god, thats just great!!

Now artist don't have to deal with that dreadful ball and chain of the Majors.

Hooray for the music revolution. :D

But heres a nice question for you.......

WHO'S GONNA PROMOTE THOSE ARTISTS?

WHO'S GONNA GIVE THOSE ARTIST LOANS SO THEY CAN PAY FOR THOSE BAND MEMBERS ON TOUR?

OR PAY FOR THE TOUR BUS.........

OR GET THEM IN COMMERCIALS........

OR PAY SONGWRITER FEES?

OR PAY PRODUCER FRONT AND BACK END FEES?

Because you see, this is what a Major does.

And, it does it ALL AT ONCE!!!!!!!!!!!

50 Artist signs with majors, all 50 of those artist (with varying degrees) get all of these services AT THE SAME TIME!!!!

FOR EVERY ARTIST IT SIGNS!!!!!!!!

Will Kim do that for every independent artist he signs?

FOR EVERY ARTIST HE SIGNS?

How will he promote them?

ALL 50 OF them?

All at the SAME TIME?

In different genres?

In your own words in a earlier post, you said yourself that independent artist would have to promote themselves more then likely, correct?

So basically, your trying to reinvent CD Babys model all over again.

So thats, what, 42 million a year spread out over 200,000 INDEPENDENT artists (if Megabox is open to all artists like CD Baby) who are doing it without the help of a major, right?

Which means about roughly 200 dollars an artist.

Which would probely be even LOWER if they are only depending on advertising dollars for revenue.....

Anyway, let me say this again to remind you....

42 million (which is not ALL investment money, btw) would be going toe to toe with over 10 BILLION in investment money...........

And industry knowhow....

And established connections with radio AROUND THE WORLD...........

And TV and Most Media outlets...........

Vs. Kims website............and 42 mill (which again, is not all investment money)

I'm not even going to get into how much that pool of money will shrink once he starts employing people to try and do what majors are doing....

Unless he takes his company public (which, again, wouldn't happen without lawsuits first)....

Your scenario is an silent epic lost waiting to happen.

You turn again....

Let me add this:

If Kim used that money to sign one or two artist to his label and just focussed on them, then he would be unstoppable (if record companies don't come after him for the money he already has)

If Kim tried to use that money to take on the labels who has FAR more money in there war chest them him, it would be Epic Fail times ten.

You turn again....

Tell the truth right now: Are you being serious, or are you trolling? Because right now, I can't honestly believe that you are being serious.

Nowhere did Kim suggest that he was in the tour business. Nobody cares about touring. We already covered this a long time ago. Kim is taking advantage of the fact that more and more people refuse to leave their house for their entertainment.

The difference between MegaBox and any other site like it, is the MegaKey, and a handful of the most visited websites in the world, and online industry connections that the major record labels don't have.

Kim is not responsible for paying for or organizing anything besides the pay per download and probably some special bonus or guarantee for already established artists. He COULD completely finance a few high end/viral songs to help build his brand if he wanted to do that too.

His name is Kim DotCom. That should tell you he was basically the boss of the internet. He has/had unmatched internet resources and connections at his disposal to completely abuse in order to see MegaBox become bigger than anything you could imagine. So please stop underestimating him.

This isn't supposed to be an opinion thread. This is a fact thread.

You told us that Kim was going to be sued instantly, I have already explained that isn't true.

Now your turning back to your opinion that it couldn't succeed, when CDBaby is successful, and they don't have the resources and innovations that Kim DotCom would put into MegaBox.

So how is it that you are coming to the conclusion that MegaBox, with Kim DotCom and the MegaKey and unlimited free traffic and advertising, and millions of his own dollars, some major industry partners, and millions more from investors, wouldn't be able to succeed? Kim already tested the MegaKey and claimed it was viable for use with the MegaBox concept.

On 21 March 2005, Dotcom founded Megaupload Limited, a Hong Kong-based file hosting and sharing business that eventually became the 13th most popular site on the internet with over 150 employees, US $175 million revenues, 50 million visitors daily, and estimated to be responsible at its peak for 4% of all internet traffic.

Boss of the internet. And he was only just getting started.

Did you read the thread all the way through before you made that accusation:

Quote from an earlier post inside this thread made by GB5000:

Quote:
And to answer you question, I've been doing music since a I was a weeeeee litttle tot, and have done some thing in the industry as a producer and writer that I will keep to myself for now.

You didn't tell us anything that you've specifically done or are involved with that would bring you any actual credibility with that quote. All you said was you "have done some thing in the industry as a producer and writer". Anyone can type that lol. You are also speaking completely in hypotheticals, which makes all your type even less worth reading. It's equivalent to saying "Hey guys I have a ton of experience and talent in ____. I won't actually substantiate what my experience and talent in _____ is but I will speak to you like an expert soothsayer on _____."

With respect to the article and news, I think it's awfully coincidental his arrest came a month after the announcement for megabox and the whole megaupload song drama happened. I am not defending him for any of the alleged crimes or predicting whether his plans would be a success or not, I am only saying it's awfully coincidental.

The guy that posts the links gets more thanks than the guy that posts the article.

Danm Kick, you sound like you on his cheerleading squad or something in that last post!

Anyway.....

Tell the truth right now: Are you being serious, or are you trolling? Because right now, I can't honestly believe that you are being serious.

VERY serious! Music is my lifeblood and main career path, so yeah, DEADLY serious MR. Kick!

This isn't supposed to be an opinion thread. This is a fact thread.

Oh Rly?????????

Here's you:

His name is Kim DotCom. That should tell you he was basically the boss of the internet.

Some people think Google is the boss of the internet, some facebook. All based on opinion. Including your statement above.

So in other words, THATS JUST AN OPINON TOO!!!!

Another one of your opinions not based on TESTED FACT!!!

I could go through your past posts but I'm a bit lazy right now, but you have a lot of "opinon" statements, so what cha tawkin bout' willies??? :p

when CDBaby is successful

Oh Rly??????????

To CD Baby itself, OFCOURSE!!

To the Independent artists on CD baby, yeah, try living off 200 dollars a year. Or even 36k a year if your among the top artists.

Ofcourse, I don't truly know this, but neither do you. So how in the hell do you know that the ARTISTS on CD Baby is just as successful as the Major artist?

Trust me, if that were true, CD Baby would be publishing articles all over the internet showcasing those artists to get more publicity to there service.

But all you hear is silence from them on that one. So yeah, who's successful individually other then CD Baby as a whole?

You told us that Kim was going to be sued instantly.......

IF he tried to use copyrighted material.

IF he doesn't use major artist catalogs, OFCOURSE, he'll be fine!!

IF he doesn't try to sign Major artists already in existing contracts, OFCOURSE, he'll be fine!

Look at the context in which I said that, and don't try to use it as a blanket statement to try and further convince yourself that I said that within the context your trying to accuse me of!

Your making this too easy Kick......

Kim already tested the MegaKey and claimed..........

Independent PROOF, Not claims.

Thank you!

Right, mostly using content Major Media, Music, and Software companies spent millions adverting to bring public awareness to there product. When people wanted it for free without paying, they followed the yellow brick road filled with links, which happens to lead to Kims site, and hence, why he had so much traffic, and the real reason why everybody is having a hissyfit (they will NEVER admit this though! LOL)

Take away that content, and you take away that traffic. let see him do the same thing with unknown artists and NO PIRATED CONTENT......

Hey Mr. Kick, if your gonna neg rep me, then say that shit in public.

Don't be a coward wit that shit.

Also, when did I change course?

Prove me wrong OUT IN THE OPEN vs. in your neg rep comments.

Your getting kinda emotional about this dude, its a debate, remember?

I would neg rep you back but I'm not gonna do that, cause this is just a debate to me.

So come out and say you peace in this thread...........

Your taking this shit too serious.........

OH, and BTW....

YOU HAVE NOT PROVED ME WRONG YET!!!!

But if you believe this as per your neg rep comment, please point out where this has happened.

did they really take the owners of Megaupload to jail? That seems quite extreme for a site that has been in use for quite some time. If it was such a crime, they should have taken it down within a few months of it going live. why now? I saw the anonymous response which was quite interesting.

Because they had to launch an investigation, the FBI doesn't just go and arrest people.

You have lost. Please stop making a fool of yourself. Please review your original posts, and notice how you were trashing the MegaBox concept and "educating" all of us about why they would get so badly sued, when you didn't even understand how MegaBox works. And you STILL think you are winning?

That business model would not be able to sustain itself.

CDBaby is sustaining itself, and doesn't have near the resources/innovations MegaBox would have.

Its not the model in and of itself that will be responsible for its epic fail, it will be the litigation it would face from courts around the world (except china and russia).

I already explained that MegaBox would only sell original content from artists under exclusive deals with them, therefore all of your point about litigation were moot.

Just answer these questions:
Have you seen a written plan for MegaBox business model?
Do you have any idea what they would consider success?
Do you know how much money MegaBox would pay superstars to sign with them?
Do you know how much money MegaBox makes from the MegaKey?

If you multiplied CDBabys traffic by 1000X, I am sure their profits would increase.
If you gave CDBaby more ways to monetize their products, I am sure profits would increase.
If CDBaby could make money from FREE downloads, I am sure profits would increase.

As you said, you know the Music Industry more then you know Internet Marketing. Well this isn't a discussion about the Music Industry anymore, this is a simple eCommerce discussion.

Your knowledge of the music industry just isn't relevant to this conversation, because we aren't talking about how you Dinosaurs THINK the music industry is supposed to be run.

It just sounds unintelligent when you claim that if someone takes an existing and profitable business model, but does it with 1000X more customers, more brand power, is able to monetize customers who are unable to pay, has more internet marketing experience, has more internet connections, and has more cash flow and investors, and much more, it is still going to be impossible for them be successful.

Don't be a coward wit that shit.

A coward? You are a Jr VIP, obviously I know you can see it was me who neg repped you, so I am not trying to hide anything. When did you change course? Your entire argument was that the reason that MegaBox couldn't sustain itself, was due to the litigation that would follow them due to them trying to sell music works owned by major labels. I already explained to you why that was absolutely ludicrous.

So now you are changing course, and saying that even IF MegaBox makes millions in profit, it won't be successful, because Kanye West can't afford a private jet with his MegaBox earnings within the first 5 years of operating. I have proven you wrong by explaining that MegaBox business model was NEVER going to be selling music by artists who are signed by major labels which you thought.

I proved to you that their intentions were to sign exclusive deals with the artists. Need me to quote it again?

You can expect several Megabox announcements next year including exclusive deals with artists who are eager to depart from outdated business models.

This isn't a debate. This isn't about opinions.

This is about facts. The FACT is that Kim DotCom never planned to use MegaBox to sell copyrighted material that he didn't have permission to do. MegaBox was going to be 100% legitimate and fully in compliance with all copyright laws. There is absolutely no reason to believe that anyone would have any grounds to sue MegaBox. That is why you have been proven wrong.

Awww, Kick you gettin emotional on me? I haven't even neg repped you back yet. :D

Kickflip, please!

Heres just one of your earlier statements:

What exactly is Kim going to be sued for if:
He purchases the complete rights to certain classic songs.

What did I say?

He couldn't, in his current state, with the current money he has now, be able to purchase those catalogs as it would be out of his reach financially.

Also, he would (and is) getting taken to court for allowing copyrighted material to be downloaded. BEcause he had servers in a developing nations, he is liable for damages to media companies.

So FIRST, before megaflop can even exist legally (he tried to go legal before shit hit the fan, he was too late), he would have to settle the debt with Other labels, as they would STILL come after him for all those back profits.

Lets get back on those "classic songs". Again, look u how much publishing companies sold for. Kim would go broke overnight if he tried to buy them.

YOU said it, not me.

And again, I said, not gonna work.

Based on PAST sales of those classic catologs.

Thats a REAL FACT.

You can't prove that wrong with an opinion Kick?

Or, I'll give you the benefit of the doubt. Lets call me statement a CALCULATED fact based on factual research and your statement a SUBJECTIVE opinion.

There, you happy?

its still and opinion though.

My statement is A LOT more believable then yours, because I actually based my statement on pasts events that have already taken place.

You however, based that above statement on speculation.

As a matter of fact, most of your statements in this thread are based on speculation simply because MEGABOX NEVER LAUNCHED!!

So yeah, you have no clue whether it would be succesful or not, you can only SPECULATE until it actually HAPPENS!!

SO WHO'S THE ONE SPEWING FACTS HERE?

YOU?

PLEASE!!!!!!

We disagree. We feel that MegaBox would in no way shape or form risk any lawsuit, and told you that you simply didn't understand MegaBox business model. You chose to ignore those posts, and keep trying to pick on little things that do not matter.

We FEEL, WE DISAGREE, if not a FACTUAL STATEMENT. Its another opinion.

So that means the statements coming after those words is also based in opinion, not fact.

The only FACTS you spewed in this thread are things baesd on what Kim released in a statement about what Megabox was intending to do, but your thoughts on its eventual success is null and void because...

IT HASN'T HAPPENED YET!!!!!!!

Can't prove that wrong, can you Mr. KICK?? Ofcourse you can't.

Because how can something be a fact if it dosen't exist?

The fuck you taking about............

Its been your opinion all along, other then your quoting Kim's release statement about Megabox. But the shit never existed and was never launched in REAL INTERNET LIFE.....

So what now????

MegaBox was going to be 100% legitimate and fully in compliance with all copyright laws

now heres my cuculated opinon on that statement: HOW was he going to go legitimate without paying those back profits to the Music, Movie, and Software companies first?

Because Any legitmente business opens itself up to litigation. Even if they couldn't go after Megabox itself, they can still go after its owner. Especially if said owner still owned Megaupload and still operated the site in its current manner before it got shut down.

I mean, dude didn't have three passports and cards with different names on them for no reason.

But again, that my "calculated" opinion.

So yeah, litigation would STILL follow Kim.

The FACT is that Kim DotCom never planned to use MegaBox to sell copyrighted material that he didn't have permission to do.

Unless he moves to China, he couldn't do that shit anyway. So yeah, I'll give you that FACT even though it hasn't happen yet!!

Oh, hold on, this is huge right here:

but does it with 1000X more customers, more brand power, is able to monetize customers who are unable to pay

O Rly??????

OK, lets take what you said and apply this to Kims situation.

{Remember kids, this is a calculated opinion, not fact. and atleast Mr. GB5000 is admitting it, unlike my counter part Mr. KickSlip}

Anyway, question for you:

1. WHERE DOES MOST OF KIMS TRAFFIC COME FROM?

if you said various links across the web sharing all kinds of content, give yourself a cookie and calm the fuck down, you need it.

2. WHAT DO MOST OF THOSE VISITORS COME ON THE SITE TO DO?

If you said download content, congrats.

Now heres the kisser:

What type of content was the MOST DOWNLOADED CONTENT FROM MEGAUPLOAD?

Porn (some homemade, most copyrighted by porn studios)? Check!!

Music (some independent, majority copyrighted) Check!!!

Movies (very little independent, most copyrighted) CHECK!!!!

Software (almost none free, majority copyrighted and cracked) CHECK!!!!

You still with me? Good!!

Now, let say Kim goes legit. In order for him to do so, he would have to get rid of ALL COPYRIGHT CONTENT HOSTED ON HIS SERVER.

Including renamed files to evade the copyright police.

Once that happens, would people still visit his site?

or would they go to rapidshare?

So anyway, Kims legit now, with no copyrighted material on his server. Since the top 10 downloads were probely copyrighted, people have NO reason to visit his site, since thats what they go there for in the first place (most people, not the one who go just to store files.).

So now, Kim has no traffic, has Megabox launched, and wants to be the next itunes for independent artist.

BUT WHERE IS HE GONNA GET THE TRAFFIC FROM?????????

Since most of his traffic source is based on people downloading content that is NOT considered FREE in the real marketplace (not the internet marketplace, software still has a price tag on it guys)

Because Hey Genius, HIS BRAND IS BASED ON GIVING AWAY FREE COPYRIGHTED SHIT!!

Don't act dumb, you know this.

Thats why his site became so famous in the first place.

And since you can't be legit playing on that side of the playing field, how was he gonna sell that service to legitimate artist if he can't garner the same amount of traffic he use to have?

So Mr. Kick, what is he gonna do about that, once he "becomes legit"?

Because when his traffic slows down....

SO DOES HIS MONEY!!!!

And if his money goes down, so does his ability to CONTINUALLY, NOT START, BUT CONTINUALLY run, expand, advertise, BRAND, and get out the word about MEGABOX and its artists.

AND this is, once again, if Media and software companies dosen't come after the money he's already made FIRST!!!!!!!

Now, that was a calculated opinion, but I wanna see you explain how he would get around that senario, since your senairo is based on the assumption that he would still have the SAME AMOUNT OF TRAFFIC THAT HE HAD BEFORE HE STARTED MEGABOX!!!!

And searching through this thread, I don't see any counter argument against THAT!!!

So go head Einstein, riddle me that...

You have lost.

You wish. Its only the fourth quarter KickSlip. Bring it......

A coward?

Yes, you are. For getting emotional over an Internet debate!!

Too many people reporting me to mods lately. If you can't see by now that you don't understand how internet marketing and corporate business works, I just can't help you. The people will read the thread, look at the facts, and come to a conclusion about who is right, and who has absolutely lost their minds.

Lets just agree to disagree.....

Tying to influence popular opinon much? :p

Don't worry my dude, most of the guys posting in this thread were on your side anyway.

That dosen't make your statements correct btw, just more popular.
