Want to know about Amazon Fba

I'm about to Open on Amazon Fba account. I just purchased thermal shirts already package for 1.99. I went on eBay and noticed that the company is selling on Amazon for up to $38! Do I have to get permission when I find any company selling product I buy to resell?
