So I know of a company who does not have a trademark/Service mark either locally or federally on their LOGO that they use heavily.

I am going to put a TM on it and try and stop them from using it.

Anyone want to be on if it will work or not? This is not about money. I am in it for the spite.

1. not just you, ff and bhw is slow right now.
2. Tip for you.
Write a letter, to whom it may concern, and detail the logo etc...
which you wanna trademark, and post it to yourself.
when it arrives in snail mail, DO NOT OPEN IT.
but keep it safe, so that if there is ever a dispute in future, you can clearly show the date which you trademarked your thing.
(of course the letter will only ever get opened in front of an independent witness such as a juctice of the peace etc...
this actually works in law. use it as backup.
good luck.

ps... dont do spite, becos it ALWAYS slaps you back in the face in the future,
think Karma etc..., but for honest and ethical biz use, then try the tip above.

A trademark does not need to be registered for it to be valid. Registration merely recognizes that it is valid.

You would still lose a suit if you began using the trademark after they did.
