Yes watch what is his doing then do copycat marketing 101. You should be doing the same thing and at the same time have a couple of sites one black and one white so you can compete. The blackhat is always going to destroy the white...

get someone here to run Xrumer on his site for a week...should get him banned right off google(I dont endorse anyone doing this btw andh avent tried myself)
Courious though, has anyone done it, if so, how long did it take?
Why would running xrumer to build links to his site damage it ? I don`t think that would work.

because i've seen his name in a program that was used to create 100's of bad links to my site. I've seen my links removed from link exchanges and replaced with his (I don't know how he's doing that one) because i saw a page he created on his site that had a nice paragraph that was filled with my sites name and why you shouldnt shop there. (that one im in the process of having a lawyer send him a nice warning about). this list goes on and im not the only one he's doing it to.
I know seo and work hard at it to do it the honest way. i wish i did know more BH techniques. believe me, i dont want to be a rat BUT when a major competitor gets away with alot of BS the game isnt fair play any more. that's what bothers me.

A ton of fast incoming spam links has been rumored
to devalue serp rank or ban. I have no concrete proof of this, but negative seo is a tactic employed by quite a lot scumbags lately as a service. You can argue that's competition, personally I don't do this or rat out other blackhatters. My definition of competition in terms of seo is using techniques and methods for your own sites, not hurting others for your gain. Then again, there is no honor among theives.

-being a rat won't help. Google/Yahoo/ MSN won't care. They only ban extremely OBVIOUS techniques, on NEW websites. They won't penalize an old, huge website, unless they have very good reasons to do so --- something he is doing ON HIS WEBSITE, not outside it - like spamming backlinks, etc... google do not deindex him for this.
-trying to get him down with xrumer and pr storm won't help. People GET BANNED using these tools, because THEY ARE USING THEM ON NEW domains and new websites. Applying them on an already established domain won't get him banned.
-Your only change? Be a man and admit that he is better than you and try to overcome him. Stop crying like a baby. This is business dude, and in a business where lots of money are made, there is no room for whitehat/blackhat delimitations. Whatever gets you to the top, that s it.
