Themes in the download section

Is it illegal to use the themes in the download section of BHW. I can see that there are many paid themes which can be downloaded free

If you are unsure about it, then buy the paid themes. no hassle, no risk with no modification or injected script.

if you want to use them you are free to use... i used some and didn't seem to have any problems with them... you can also read comments, other people use and test them too so if there are problems sorely someone will post there a reply regarding those themes.

Yes its illegal. But if the theme owners have a problem with it, they can file a complaint with mediafire, or whoever is hosting the actual shared theme.

Go ahead dude, someone paid for them already. It's not stealing imo, it's copying. Stealing implies that you took it away from someone else.
