There are 2 protocols to txt msg one being SMTP(Simple Mail Transfer Protocol) and then SMPP(Short Message Peer-to-Peer). SMTP is the standard email sending protocol and SMPP routes the message through a gateway that connects directly to the carrier. I believe SMPP is much more common these days in terms of text messaging and harder to regulate against spam as it's not through the traditional mail transfer protocol.
I am not saying go crazy and start spamming texts to all kinds of numbers as that can probably get you a subpoena pretty quickly even though prosecution in this area is a completely different story. I'm going to look more into this, the legalities with can-spam and how to legitimize sms-gateways through SMPP. Quality thread and informative replies.
