Soundcloud Threatening to take me down

I have a website where I sell social media services, one of the sites I cover is Soundcloud. I received the following email last night:

They also banned the account I had on Soundcloud under the name of my website.

In the email they say I'm infringing on their name and logo. Well, I do have the word 'soundcloud' on my site, and I do have their logo in 3 places. But they say I'm misleading people into believing I'm affiliated with them. But in the footer I state: "[My Site] is not affiliated with or endorsed by SoundCloud. The SoundCloud logo is a registered trademark of its respective owner."

This is a big blow for me. What are my options?

I'm thinking to buy hosting with some offshore whatever hosting provider who would ignore any complaints. By the way, that website has been whois guard since I created it a few years ago. Could they really find where I'm hosted? I'm hosted on US and domain on UK.

Or to take down the Soundcloud page from my site... at least for a while...

Or to ignore them and see if they're bluffing or not. Problem with ignoring them, if they're not bluffing then I could lose my entire site, not just the soundcloud page.


p.s I'm almost 100% sure this is legit. The email came from Soundcloud, and they also banned 1 of my Soundcloud accounts, the one I had under my website's name.

I think you can shut down soundcloud related services. Or move to offshore hosting.

Tell me, would I only need to host my site offshore or would I also have to move my domain name? Right now my domain name is with a UK company.

There was a time when on Fiverr and SEOClerks you could find thousands of gigs offering services for all social networks, very openly and precisely. I'll give you 1000 youtube views, I'll do 10000 twitter followers, etc etc. Then at some point fiverr removed all such gigs, and seoclerks soon after.

Now it's more vague. Now people offer "promotion marketing" services and stuff like that.
 
If you are using their name in the url and their logos on your site they can have you shut down; just move offshore.

Maybe right but just wondered how over 900 use the name in their titles, not exactly covert on seoclerks or fiverr

I just might. Tell me something, would I also need to move my domain registrar? Or just the hosting provider?
 
This is interesting. I also have a website where I offer SMM services, including SoundCloud. Can they threaten me if I don't use their logo and mention in the footer that the site is in no way affiliated?

They probably can, but they probably won't.
 
I really doubt that moving to offshore hosting helps you much. If they will start digging, they just checks who owned last hosting accounts, or domain and you are busted. Offshore host with domain + new domain(brand).

Other more established members above suggested offshore as something that would work.

I mean, once I move to offshore, even if they find my current hosting provider, it doesn't make a bit of difference since my site will now reside elsewhere.

But I'm unsure about the domain name registrar, if they can get to that. The site has been private whois from the beginning.

IMO you would need to start again with a new domain to be safer.
Is this the same domain you have set as your BHW homepage?
I think they can only seize your domain if you are using their Trademark.

Yeah you will still find services on offer but most aren't so blatant and they get banned quicker than they used to.

So they can't go after my domain name then, probably.
