Hi charlie3,
I agree with the members on this thread who've posted the advice to check how he's ranking.
I have and still am experiencing the same thing. I am always looking for the best ways to use my time so I studied how this site that's used my content is ranking and they're just using comments - it just improved my knowledge.
Also the other content is poor quality compared to mine so it really helps me understand more how g works.

Send DMCA to google, they will remove his site. I had them remove a site from google about a year and a half ago and it's still gone. It was a EMD, and I'm guessing it would be on page 2 because at the bottom of google it says:

Oh well, revenge is all I see in this thread. Nothing constructive at all. The guy who was labeled an idiot by the op is not an idiot afterall. He/she is a genius for outranking the original op.

I don't really understand what the problem is. Google doesn't penalize duplicate content; they rank the one with the most links. As you rank more in the SERPs, more people will scrape your content. It's just the way it is. Build more links and this won't matter.
Seriously, don't waste your time. There are going to be a dozen other sites that scrape your articles, possibly spin them, and use them for their own sites. Hell, half the people here scrape and spin articles. Use your time to do something constructive that benefits you, because even if you "take down" this guy, there will be 20 more next week. Your time is (hopefully) more valuable trying to boost your own site rather than chasing down article scrapers.

Nope, it's registered with one of those privacy information sites.
That sucks and I am sure I would feel equally frustrated in the same situation.
However I think this is the wrong place to complain as this site is more about scraping articles and re-using them rather than creating unique and valuable content. We could spend our time on one of the more business oriented or whitehat sites but somehow it is less appealing to us. I am suprised so many people want to offer to take down his site for carrying out exactly the methods we share and discuss here.
I am not doing this anymore as its not the method for me, but I played around with autoblogs a little a few months back and got comments from annoyed people for stealing their content. Sure its not a very good thing to do, but if i felt that was the best method for me to make money I would be scraping content all day long. Actually I still do this in a way because I take articles, spin them a bit and spam them all over the place just to get backlinks and feel good about myself while i do it.
Try not to let this get you down, concentrate on creating more good content (and maybe some scraping and spamming as well) and you will do just fine.

I'm quite surprised that so many people are saying there's nothing you can do.
Write the letter and send it to him and his abuse department, if any of the articles have been taken off an article directory write to them and tell them they're expressely breaking the terms and conditions.
Also investigate the rest of his content, if he's doing it to you, chances are he's doing it to other people, contact them and inform them.
Take a look at his host, investigate the terms and conditions and inform them of infractions.
Something else you can do is start writing the articles in HTML, throw in a few java script extras and start scrambling your code. This wont stop anyone that determined, but a lamer who's resorting to stealing articles isn't going to be able to work it out.
Another option would be taking a note from Flikrs book and adding a transparant image over your articles for a few days until they're indexed.
All off thats of the top of my head and wouldn't be that difficult, I'm sure there's plenty more that you could do

definitely a DMCA letter to his hostign company....I had the same thing happen to me....he was hosted at Go Daddy I had his site shut down

How can they shut your site down, any idiot can say shut there site down how can you prove it was your article first ?
There are some good advices here.. I'll just add my 2 cents. If I were you, I would start working on my SEO to outrank him. Put some backlinks on your articles, so if he only copy paste it, then you'll have more backlinks coming from him This of course, assuming that the dude is really dumb

I believe I read in the BHW forum about a guy that includes the full url to his site in the first paragraph when he writes his articles. When the article gets scrapes the link is intact. This way if they don't include your resource box you still have a link back to your site.

However since you said you had affiliate links can you use a http redirect?

The other side of the coin. We provide software to automatically scrape sites for articles and then people come here and complain about it too...
You could try the hosting thing, but I'd suggest just ignoring it unless this is a big money site. If you're not making much from it to begin with, may be better worth your time and effort to continue more new sites on the side.
