Scammed !!! Please help me out.

I m luckyman, I sold some high quality autoblog network at Flippa. Network are of 3 to 5 autoblogs. Each autoblog ranked on highly completive keywords and get around 1000 unique hits. SO, blog network get around 4000 to 5000 Unique hits, autopilot, and they make around $200 -$300 per month

The problem, I sold this one on 26th Nov. This network make around $260, in last 30 days.

I hand over to buyer every thing, and every thing went smoothly.

ON second week of December i get message from him, that its not making that much, By the way, he get 2 sales in last month ( December). I suggest Him to wait till JAN, because, Generally sales are less in December, but will pick from Jan and remain more or less constant. And he agree on it.

But again, In last week of December, he as for refund....so okay NO problem. I will refund on 16th Jan. )) and he agree on it.

Because site was hosted at my server, and he don't want to continue, so i change my affiliate links. By the way, it make $220 in last 10 days. ( sales pick up In Jan)

But, today, "he has opened a dispute for the payment made on 26-Nov-2010 indicating that the item they received did not match the original description."

The point is

1. Domain names are in his account

2. Traffic is as it is of 4000 unique hits

3. Sales Varies. I told him several time, but he did not listen to me. Its picking up again

-When i m not cheating any one, when why should i Scammed?

- is flippa like this, one one buy a site, and after 30 days, i get an message, " i don't like it" i need refund?

- should i refund in that case?

Please suggest me what to do? should i accept charge back? provided domain names are not in my custody? OR no point in refunding, as Awsats is showing that traffic is same and sales are coming

it seems you used paypal

flippa can;t do anything in this case

better talk with buyer and try to solve that

if not success try to take back domain

did you push domain or transfer ?

both is different

with push you have low chance that ur domain get back

but with transfer you can get ur domain back during 1 month (depend on host)

i already had same problem with me before

and i took domain back and also i win the case in paypal

Yes last month sales were down, And its due to Holidays. I told this to DAVID, and insured that it will pick again from Jan)And its picking up again. I have Awstats and all the details.
By the way, domain names are still in MR. DAVID Custody.

It will be hard for you to win a dispute with paypal over an intangible item, I strongly suggest you give them a call and sort out the issue over the phone.

It might be a lot easier for you to contact the buyer and get him to transfer back domains, then you can try and resell the site again or keep for your own purpose.

Let paypal know the conditions under which the deal was made, most especially about the domain names. The guy could also be out to scam you. He has made some money even during the period of low sales. Let him have the domain pushed back first before pressing ahead on anything.

I could be wrong here, but I thought Paypal doesn't protect against digital or intangible items. Wouldn't this mean that you automatically win the dispute since the buyer wouldn't be protected?

I personally wouldn't refund him and just try to let the dispute run it's course. If Paypal asks for it, provide all the necessary info and send them the auction URL. I think you will be fine, but then again, you never know with Paypal.

If at the end you would have to refund him and get your sites back, it might be worthwhile to keep the sites. I personally would not have sold the site for the amount you sold to the guy. Too low in my opinion.

he is definitely not entitled to a refund. He probably realized a few days after buying that he actually couldn't afford it and figured he would try and get a refund. He might as well have lied about not making any sales or screwed up the affiliate links somehow. Unfortunately since you used paypal it's kind of hard to win the dispute.
Best you can do is try to talk some sense into him. Tell him that if he carries on with the dispute you won't give up and paypal will keep hold of the money for a couple of weeks anyway, so it's best to just reach an agreement: either tell him that sales have picked up and you will give him access to the site again if he ends the dispute now, or, if you think it's worth it tell him you will end the dispute on the spot and refund him if he transfers the domain back to you.
Either way, I wouldn't wait to deal with this through paypal unless I know I did everything else possible.

Any ways, that network is getting around 4000 to 5000 hits per month, and making around 250 pm but still.
i know, how to make sites, i can make more networks.
but if any one is working honestly, and get scammed, then...))

well, Just an idea.. MY moral vaules are not allowing me to do so..

why not buy some good sites at flippa and other place, paysome thing with PP, and then within 45 days open a dispute. in this way, we can get sites, every hting, without paying any thing.
may be doable, but i can not do it.

Lesson for me
1. Don't use PP
2. Escrow is better option
3. lastly, if site is getting claimed traffic, then no need to go for refund
4. Buyers buy my some sites, it does't means that he buy me. and treat me a s my slave

I wouldn't get so worked up about it just yet. You didn't actually lose the Paypal dispute as of this time from what I've read. Yeah it sucks that he's disputing it in the first place, but I have a feeling you will win it.

Word of advice: Next time you use Paypal (if you ever do again), get your money out right away. Every time I have someone pay me with PP, I transfer it to my bank account the second I receive the payment. Paypal can't take money out of your bank so even if he won the dispute, he won't get anything back.
