1.) Do not ever respond to the complaint. ROR is indexed insanely quickly and responses just add to their unique content. Those sites are SEO'd out the butt and posting on there is a trap!
2.) Don't use your own expired domains and WP blogs unless they're relevant? What's worse? Having your SERPs flooded with complaints. Or having your SERPs flooded with spammy looking WP blogs on irrelevant domain names? Keep it all about the company and do it with 2.0 sites. You can rank these easier than you can a separate domain. Especially for specific keywords!
3.) No offense to him, but foreclosureking sounds silly.. "None of that stuff works! You'll never get rid of the complaints no matter what you do, courts will never hear your case, hire me!!"
A few things further about this stuff....
1.) That stuff does work because these sites are not magical. It's just like outranking any other website, there's nothing special about them and they don't get preference from Google over any other site on the internet. Don't buy into many reputation management company's hypy BS that they're going to be doing something special for you and there's nothing you can do about it yourself unless you're some type of SEO doctor. Again, that's BS and if you pay attention, they all sing the same song. It's basically a free meal for them, reputation management is not any more difficult than any other SEO campaign, but the cost is quadrupled.
2.) A court most definitely will hear a case about a true statement. You're talking about civil court, I can sue you for anything on God's green Earth that I want to and the courts will listen. Plus, if you don't show up or respond in a proper manner (according to local court rules), I win by default!! That's the point of civil court. A cease and desist from a lawyer can work wonders here also, you don't even have to follow through with it, but the threat of being dragged through court, costing $10,000+ and taking a year to win is enough to get most people to stop. Even here on BHW, go and look how many people will bend to a C&D even if they know they're right.
However, unlike eBayMafia said, it would not be on them to prove truth. It would be on you, as the plaintiff, to prove what they said false. The burden of proof is on the accuser.
3.) The level of difficulty depends, like anything else in SEO, the keyword! The reason they rank so well is simple onsite SEO, proper use of keywords/tags, text formatting, etc. Not because they're magic, they just appear as extremely relevant to Google. So pretty much any linking campaign will boost them hugely, because like I've been saying to people for years... The amount of backlinks you need is directly related to the quality of your onsite SEO. If your onsite is crap, you will be building 10X more links than me if my onsite is 10X better than yours.
Anyways, don't read into a lot of the BS that surrounds reputation management. It's just another SEO campaign with even easier keywords to rank. Basically, if somebody ends their sentence with "hire me" or "contact me for a quote," take what they say with a grain of salt. Because I'm not sure if you've ever priced reputation management.. It's highway robbery.
