Yea, you have to be careful. Because even if they violate TOS, at the end of the day, the legal system can argue that you empowered them and cme after you. You have to make sure you do your due diligence and make it obvious that you are trying to minimize access to bad actors.
Not really, you're covered by the TOS but not fully legally covered - it doesn't fully absolve you of legal implication in case this happens.
If the users perform not-so-legal things on your devices, more than likely you can be on hook for it.
